The amount of gymnastics it takes to have this type of false equivalency is astounding. Hello it’s called the civil rights act of 1964. The court has ruled on gay marriages and I see no connection legally at all.


The Civil Rights Act didn't legalize interracial marriage. It was Loving v. Virginia. And as you pointed out, gay marriage was also legalized by the courts in Obergefell v. Hodges.

The reason these two other cases are brought up in conjunction with Roe v. Wade is because, much like Roe v. Wade, they're not backed up by laws passed by Congress. So if the courts can overturn Roe v. Wade, making access to abortions decided at the state level, what's to stop then from overturning those other two cases removing federal protections for interracial marriage and same sex marriage?

It was Alitos draft and I seriously doubt it was him. Just because it was his draft does not mean he leaked it. The draft opinions are written/typed/created and then they are sent to all justices for review / comment / etc.

Thank you for clarifying those court cases. As a libertarian I don’t see how it’s any of the government's business who gets married to who. Since marriage is a traditionally religious ceremony then I can’t see how the court or any state Supreme Court or state legislature could violate freedom of religion if they attempted to ban inter-racial or gay marriage.

I am of the same opinion with abortion. Let the people of each state decide what’s legal and what’s not legal. But the constitution restrains the governments power. The constitution does not give the government power.

The difference between inter ratial or gay marriage is these things are protected by freedom of religion clause and I think the Equal protection clause.

And with abortion no one can agree when life starts and also why is it when a woman is murdered with a fetus the state prosecutes two homicides if that isn’t a human being?

The liberals kind of shot themselves in the foot over this lately. Their biggest argument for pro choice is a woman has the right to make decisions about their body and the state doesn't.

Now that we are in 2022

1. The state can and will not only make medical decisions for each of us they will mandate it too. So much for my body my choice statement.

2. There is no such thing as "woman" anymore, so don't be saying men can not debate on this topic. Those that we call human incubators will need to follow the laws as they come forth as there is no such thing as "women rights" anymore.

Sorry, you dems created all this and now you will need to live with it....

Last year I made some comments about "there goes my body my choice" and that all this Vaccine mandate opens the door to reverse Roe vs Wade.

You would also need to look at the implications of leaking the document. Protests / Riots , property destruction, injuries to person, to private homes / private businesses, injuries to 3rd parties, law enforcement...

A misdemeanor can quickly become a major felony.

When Ashton Embry was arrested in 1919 for leaking Supreme Court decisions to Wall Street investors the DOJ struggled to come up with a crime to charge him with. They eventually went with conspiring “to deprive the United States of its lawful right and duty of promulgating information in the way and at the time required by law and at departmental regulation.”

The case was appealed up to the Supreme Court before being dismissed.

Granted that was over 100 years ago and new laws have come on the books but it's the only case I can find where someone was charged with leaking Supreme Court decisions. But it's hardly the only other time decisions have been leaked.

In fact, Roe v. Wade had a number of leaks surrounding. Including the final decision, which ended up being published by Time a few hours before the Court made their ruling.

I guess you can take it any direction you want. All law and order will die! We can take it the other way too in Roe vs Wade opens the door for whom ever is in power at the moment to dictate anything they want well outside the constitution.

Make the legal age of consent 8, or allow abortions up to 1 year after birth, as examples...

Tried to find more recent numbers as they are declining which isn't surprising after the last two years or so.

But yeah, I don't think a majority of those were life threatening.....at least not in a way a 20 something might define it.

Normally I would agree with its none of the governments business but we need to remember that it is the purview of Congress to decide what official documents from one state must be accepted by another state.

As an example your drivers license, your marriage, court rulings, etc are only valid in the issuing state. The Full Faith and Credit clause of the US Constitution is what forces the other states to accept the drivers license, marriage, court actions (criminal and civil) etc.

US Constitution Article IV, section 1 - Full Faith and Credit Clause
