I'm not sure if this has any relavance but why did the DA call it a raid instead of just serving a search warrant? Is serving a search warrant and a raid the same thing?


No, they are two separate things, at least normally.

Serving a search warrant means that some police (or in this case FBI) will show up with the warrant, keep a watch on whomever is at the house while other law enforcement officers search the house, which usually ends up with your house being turned upside down.

A raid is a pre-planned attack on a house, also served with a search warrant, or some sort of warrant which allows the law enforcement officers to enter the premises without consent from the owner of the house. This is usually done with people, for example, like a drug dealer. They will have no idea this is coming (usually, unless there's a leak) and a raid is treated with much more care because of the possibility of return fire/fire-fight from the people in/at the house.

So yes, they can be put together, but they are also two separate things. In the case with Darius Hill, they pre-planned this attack and from what I have read, and from what I know, and from what I believe, they had pre-planned to hoax the situation to make it look like some sort of suicide while instead they were coming to execute him.

No-knock warrants (as they are called in various parts of the world) are used when there is a risk of the person in question destroying evidence before the police can effect an entry and secure the premises. It happens commonly with drug dealers, computer hackers, and child pornographers. All of those folks have evidence that can be quickly destroyed (by flushing down the toilet, or deleting from a computer).

If the police are going to search a barn for stolen cars, they don't need a no-knock warrant, as the cars can be secured without even gaining access to the barn, simply by blocking the entrances to the property.

Yes but in the case with Darius, they used the whole "child pornography" criminal charges as a ploy to gain access to his home in Hilltown Township, Pennsylvania. Obviously they could have pretty much used anything to gain access but since they chose a criminal charge that makes people think sickly of the person being charged, less questions are asked.

The warrant that was served to Darius and his family at his home was a bunch of crap, not only did the FBI not follow protocol (if you'd like to prove me wrong please show me where it's protocol to take the family to the police station and hold them there without explaining anything what so ever) but they retracted statements, which yes I know happens, but the statements they retracted were important facts that can make or break a case.

On top of that, the carpet with the blood on it was removed from the house, and I have not seen any reports on that carpet, and I've seen no reports of the gun casings/gun holes showing that the official story was true. Basically, the FBI believed they could do whatever they wanted and get away with it. Well they may think they have gotten away with it but they haven't. I am getting more information daily, and am getting more facts together.

By placing backup files in various locations I have assured myself and others who care about finding the truth about Darius's death that the truth will be found and the facts will be available to the public when the time is right.

Until then however, I appreciate any/all information regarding Darius's life/death that anyone can find that they believe may help this case be re-opened and/or proven to be a cover-up.

I have been skipping pages being typed faster than I can read them.

As a foreigner I am surprised that an object (a carpet) would be removed
from a crime scene before everything was investigated by a special team.

I am surprised, too, about the number of officers (6+4=10 ?) necessary
for a normal search warrant and why they would clear the family from
the house.

Officers in the EU would not have to fear a shoot-out, because hardly anybody
is allowed to own a gun.

If they FBI were to admit something like that it would at least give back Hill's name, but the point still would stand "WHY?"

I need to know not only who, but why, and also how.

I am getting closer than before, but at this time I don't have full proof against any certain person(s).

I am however still awaiting return letters from the CIA and Marine Corps. Does anyone have any idea how long it may take to receive the return letters regarding Darius Hill's death/records using the FOIA?

I am certainly upset to hear about your friend.

You should consider asking his wife to demand proof of the 'porn' accusation. If it came from his computer the 'file/s' should have his computer's signature, and date. These are hard to forge. If they refuse, then there must be something wrong.

I have a few questions if I might ask?

1) Did CPS take the kids? (I might have missed this over thirteen pages)The gestapo usually will do that due to the fact an accused child pornogragpher is in the house. User/creator doesnt matter, they are supposed to for X time period. It is one of the holes in the FBI's story.

2) Have you filed FOIA letters with the FBI? Ask for the proof in the case. The suspect is dead and no privacy issues exist unless the estate files an injunction itself. Ask specifically for reports

note me personally I would not ask directly but have someone else do it from a drop box.

3)@ the gentleman with the friends in the FBI- I can only pray your friends are honest. My question for you is I thought the FBI took oath similar to the military when they joined.

IMO, it was mishandled completely by the FBI. If they intend to use gestapian tatics they should study up on them better. Why were no non lethal weapons present with kids in the house?

Yes I can second guess the Nazi like tactics.

First they should have never allowed the situation to come to that. Proper pre planning prevents piss poor performance. I have had to have it literally beat into me that my life depends on eternal vigilance when on duty. You control the encounter from opening to close. No excuses period, you take charge of the post and all government property in view!

Why not arrest him while he is walking to car or in a more public open area?

second, they never should have been their in the first place. He was a US citizen with legal rights they where supposed to protect.

Before this whole arguments gets heated. I have several friends in different places with law enforcment. They go out of their way not to get into situations like has been described here. I asked them. They said it was best if I just stayed out of it.

Im letting you know I am rebuilding my life and a power structure. I am making allies and friends with deep roots. The secret I have the found is to find a niche that others ignore and fill it.

there are some good resources here on how to maintain your privacy while you search.

Using the methods they describe-

hire a private investigator to quietly snoop and find out everything you need to know.

This is bugging me more then it should....

Well, I am going to look into this, not having read much I have found this much.

Now, having put the name darius in under Member Names, I will say that member registered and has not visited since June 28, 2008.

Six months after the story.

This makes me wonder if a family member knew of this person's ATS membership, but did not know the specific name and or password and registered in order to read, suspecting foul play, and only read trying to figure out what got their friend, family member, etc "suicided".

I am speculating, completely, I am not saying anything therein is true.

I however am someone who knows how to investigate.

That member name jumped out at me when I saw it.

There are no posts, no thread, nothing on that member's profile.

Odd to say the least.

1) Darius discharged from the marine core

A) Contention over discharge


2) FBI came to house with warrant

A) Warrant means signature of judge on paper
B) Evidence presented to judge- saw fit to issue warrant (700 counts CP possession)


3) Wife opens door FBI comes in go upstairs (seven men confined space)

a) Wife taken in for questioning
b) Tell her husband is dead


4) Darius has seven bullets in him

What has been said:

Opinion:
So far not enough to justify a legal need for immediate danger clause, Why you ask? CPS and or CASA not present at raid to ‘ensure safety’ of kids. Accused perp could have been apprehended with safer methods to general public. Had no clue FED’s where on to him. (being devil’s advocate) Goal of apprehension of suspect is minimum danger to officers and public. Grab him while he walks to car and taser. No chance of resistance or using combat skills to resist.

3) FOIA request to CIA and ????

Opinion:
Don’t forget FBI and other agencies involved(hit the Marshalls with a FOIA request as well). I doubt seriously request will be approved (DvA). Accused Perp part of bust on network of CP’s? Excuse most likely used, ongoing investigation. I have heard nothing on this here of other bust related to raid. Otherwise accusations of production would be flying and kids would be in custody of CPS.

4) Cops killed innocent man

Opinion:
Really ranks of amateurs involved if it turns out to be true. What should have been done (how I would have taken him out). Grab perp at store or as he gets out of car (with taser). Kids picked up at daycare or at school by CPS. Due to the nature of the charges against him, have bailed denied. Odds are he would have folded already due to previous habit of folding in high stress tensors situation. Put him in general pop and have a jail house informant rat him out. (this is assuming parties involved are corrupt already)If he survives to trial, he has long hard odds of making it out of jail alive. Informant plus evidence enough to bury in court and odds are in favor of conviction.

Why do I say amateurs? It Left way to many questions, way too many. I was always told that cleanliness was next to godliness. Loose ends invite questions. On the other hand, if it was truly professional, that leaves only one conclusion. He was Used as a message being sent to others. Does he have other family members or friends with questions on them?

This leaves a nasty question.

5) What was the reason he was killed?

Opinion:
Money, Sex, Drugs, Knowledge

It is usually one of the four. He had something going on that was huge and as a minor player was sacrificed. Either direct involvement or associations

Money- you can find out about- debts ect.

Sex- cheating with wrong women , ect

Drugs- would have been dragged out in autopsy as evidence highly doubt

Knowledge- This is the dangerous part- Time of service

A) Contact old buddies in unit
B) Construct timeline of all behaviors (include police version- you might find errors)
Ex- when email sent where was darius
Make sure tl goes all the way back to childhood
C) Dig for journals
D) Wife can get cell phone records
E) Quiet interviews with associates(church, clubs, bars, organizations)
F) PI- investigate agents (if your right odds are they will quit on you)
G) Leave no stone unturned

Well thanks for putting the time into typing up your posts. I am trying to get a hold of more information myself - all the time. Any/all information is welcome because it can help piece things together.

The ideas you have to help me piece things together are good ones, and most of them I have thought of but have been forgetting since I've been overwhelmed still about all of this.

Can anyone answer my question on how long it will take for me to receive my letters from the CIA/Marine Corps?

Hey guys, I stumbled on this post a while ago and find it very interesting. One of my closest friends, this past week, was sentenced to 5 years in a fed. prison for a plea to one count posession of CP. Needless to say my friend is totally innocent, and what the FBI did was toatlly disgusting. Thank God, myself, his family and friends know he's not that type of person. What happened to him was so disgusting and a horrible breach of justice, he has be requested by several people to write a book about his experience. He has been doing some research, between the time of his plea and sentencing, with people in similar situations, lawyers, both defense and prosecuters, and a few retired FBI agents, and it's pretty bad, how things are run.

For the most part I will give you some info from what his lawyer (fed. pub. def.) told him and how the FBI conducted themselvse, 95% is coorberated by his mother.

Two Novembers ago, the FBI arrived at his doorstep asking to speak with him. His mother answered the door and asked the agents if they could come back another time, because his family was leaving for out of state that evening, to be with his uncle who wasn't expected to last another day (cancer). His mother closed the door and went to ask my friend why the FBI was there asking for him. I guess he was comming down the stairs with his mother, and the agents were standing in the house. His mother thought nothing of it because "hey, it's the FBI". They told his mother to leave the room so they could interview him. They told him that this was just a volentary interview and that they would leave anytime he wanted them. During the interview he asked them twice to leave, because he had alot to do before leaving that evening, but they "kindly" refused. After alot of odd and very vague questions, they insisted on taking his computer. He told me, that there was nothing that he told them, that would lead them to believe that there was CP on his computer. In fact he had told them that his original computer literally burnt out and that week, and he had another one plugged in. For all they knew, it was a brand new computer. Still they insisted on taking his computer. His mom had just come out to get a glass of water when she heard them talking about taking his computer, and he said "no" twice, then they treatened his with a warrent to come and get his computer, and he said "ok, you can get the warrent", then they asked if they could see the computer so they new which one to pick up. So he took them up to his room, and when they got in there, they just walked over and started unplugging his computer. He said that he had to help because they were being a little rough, and he wanted to make sure he got his computer back in one peice. When they got downstairs, the agents told him that they would like him to make a statement about having CP on his computer. He said that he thought this was really odd since he knew there was nothing on his computer, but they told him that if he didn't write a statement, they would have him arrested until the search of his computer was finished, which would take at least til after the New Year. He said, "What could I do, I didn't want to miss saying goodbye to my uncle, and miss his funeral and the following week grad school was starting the 2nd quarter of his last year, and he was grad assisting, doing thesis research, and had to take sequencial classes. He told them that he didn't feel comfortable with the idea, but the agents told him that if there was nothing on his computer, they would tear up the statement, and if there was something on his computer, they could used the statement to lessen any type of punishment. They told him "Either way, we're not leaving without a statement". He said it was a combination of him lying, and the one agent coaching him on what to say. They took his computer, and statement and left.

Him and his mother didn't think much more of the incident. They both said..

"Hey, it's the FBI, we trusted them. Why would you not, they are here to protect us". Trust me, neither him nor his friends and family believe this anymore.

3 months later he was arrested. Turns out that there were 10 small video clips on his computer 7 in the background info and 3 on his desktop. But there are some major problems, first about the computer that they had taken...

The computer was put together in the September of the previous year, and was having serious problems with it. It had been hacked several times, seriously riddled with viruses, at one point he saw his computer was being remote accessed and quickly unplugged it. I knew all about this before the agents visited. Files and images would appear and disappear from his computer. It was so bad, that he had to reformat his computer 5 times between that September, and the following March, when he took it of line and built a new one (this was the one that burnt out). So this plagued computer was disassembled and in another room between March and November. the reason he kept is was that he couldn't decide whether to sell the parts or use it to start a render farm (he does computer animation). With that said...

Three of the videos were downloaded to the desktop of his computer in July and August, with in the time that his computer was in peices. Other ones were downloaded during times he was in school, and one was supposidly downloaded during the time of the FBI interview. The funny thing is, is that my friend didn't downlaod even regular porn on his computer, because he had this horrid fear of accidentally handing the porn on DVD rather than his grad projects.

Somethings that he was told by his lawyer and other lawyers he had talked to...

The FBI, when it comes to investigations, they are lazy. They only dig far enough to get enough info for an arrest.

The FBI are ruthless and play dirty. They will do what they need to do to get an arrest.

The FBI always need a body for the crime. They do not care if you are innocent, their only goal is to put someone in jail. If you are an easy mark, they will take you over doing a hard investigation to find the real criminal... a bird in the hand...

CP's are easy marks, the FBI know it's impossible to know if that person actually downloaded CP, or if their computer had been zombied or remote accesed. Again, they are lazy, they will put the thumb screws on the person that they have until they basically have no choice but to plea out.

Alot of times, if the agents "believe" a suspect is downloading CP, but they have no proof, they are more that happy to "find" stuff on a computer.

The FBI agents will ask suspects questions that are so vague, that any answer that the suspect gives, is totally left up to the interpretation of the investigating agent (kind of like how horoscopes are so vague, the a person reads into it what they want).

There is almost no way out of a CP charge. In federal courts, the burden of proof is placed on the defendant, not like in state courts, where the burden of proof is on the prosecutor. If you don't have proof that you're innocent, you're screwed.

He was told by the computer guy (who works for the pub. def.) that investigated his computer, that he would have to give him (the computer guy) an idea of how the material got on his computer. Seriously?? My friend knows enough about computers, but not that much. The computer guy said that is would take about 2 years to do a thurough examination of his computer (a small 40 gigs) to determine where it had be tampered with or not, and the prosecuters would not wait that long. Also, the only hard drive he was allowed to examine was a mirrored copy of the original.

Another lawyer told him that when you are charged with CP, there is literally nothing you can do, except minimize the damage, and try to keep it quiet.

He was told straight out, that the FBI has been caught several times with placing evidence on peoples computers.

When they were found out, the charges where immediately dropped.

He was originally looking at 3.5 years, 2.5 with good time figured in. But a week before he was to go in and accept his plea deal, the governement changes the penalty to a manditory minimum of 5 years for any CP. He was now looking at 8 years rather than 3. His lawyer fought with the prosecuter and was able to get him to agree to the minimum.

The poor guy is devistated, he can't figure out why this happened to him. One day he's busting 36 hour days in front of his computer trying to work on his thesis, grading projects, trying to find a job and doing homework... to going to jail for a crime he didn't commit. A lawyer told him that it sounded like, when the agents got to his house for the interview, they had already decided that he was the one that they were going to pin it on.

There is so much more to his story, hence his book, and he had a ton of # that he's gathered.

Anyway, say a prayer for my friend, and others who are getting screwed by our wonderful governement.




PS... OH, there is a pont system for CP, 1 image = 1 point, 1 video clip = 60 points. 600 points = 1 charge. So when they say 600 or 700 images were found on a computer, it is most likely only a handful of small vid clips.
