"Russell Brand is accused of child abuse?"

No. That's not what I said.

"Because it is not fair to the accused to try to put up a defense after all those years."

Like I said, there is no limitation.

You don't have to be a paedophile to disagree with this law.

Was it not fair on Nazi war criminals?

Delaying doesn't make success any easier.

Some delay may have justifiable reasons, yes. YEARS? NO

If the victim is a child it may take years to reach a state in which they understand what happened and/or decide that the culprit should be punished.

The same thing may happen with adults that are in, for example, a fragile job position in which their silence may be the only way of keeping their job.

We can never know what a victim thinks unless we are one, and even then each case is different.

They were in hiding for years. Not the accusation. The perp. When an accusation is in hiding for years, then its by nature, going to be much much harder to prosecute and defend.

Depends on when the accusation is made and the evidence gathered.

A perp in hiding for years is not the same thing as a crime not reported for years.

what happens if there has been a miscarriage of justice and the wrong person gets executed

Well, yes. But not impossible and, there is no limitation defence.

I was answering the controversy about Brand, and adults not reporting rape. Why that is controversial.

It was a deflection that I didn't make. And should not have addressed.

If it's a child, that is whole other ballgame, and why I think the penalty should be harsh.

True, but is the death penalty that harsh on the criminal?

I know it's the ultimater penalty, but it ends fast.

Some years ago, in Italy, there was a kind of movement by people sentenced to life in prison asking for the death penalty to return, as they could not stand life in prison any more.

I know punishments today should not be "inhumane", but prisons shouldn't be a place where a person feels good, it should be a place where a person feels bad and, preferably, is made to think about how their lives could have been if they hadn't choose to commit a crime.

Thats why we take so long to actually execute anyone. So that we are sure of the facts. They also get automatic appeals.

I dont care about making them suffer more.

I care about protecting society, even guards and other inmates, from them.

We have a saying:"If you can't do the time, don't do the crime."

But it has happened the wrong person been executed.
is the justice system perfect?

I think surgical castration with removal of tongue and hands will be a lot better than just killing them and putting the rapist criminals out fo their misery, they should be left to live their rest of their life in scorn and exposed.

Only states like California will protect them, I predict a migration of pedos from Florida.

No surprise the media is mad about it. Many of them were buddies with Epstein.

Yes, it has happened. And it has happened that people serving life are later found innocent, sometimes many many years later. So should we not have long sentences either? I'd say that happens more frequently than DP mistakes because of the automatic appeals for DP sentences.

Nothing is perfect. Life is unjust. We can only try to make things fair.

Most of the time, these predators will "repeat" to the same victim multiple times. Why would they throw away that chance?

True, but even if those that may think about killing their victims are only 1% of all rape cases, the fact that they will are likely to get the death penalty may change that number to 2%. Even if it changed from 1% to 1.1% it would be too much.
Even if it happens only once it will be too much.

If they were going to kill at all, one would assume they would do that from the beginning. Knowing that when convicted, most child rapists don't last too long in prison before they are taken care of by others inside.

I have seen several people saying that things aren't like that in many prisons, they just don't care much if someone was sentenced for child rape or not any more.

Do we have any ATS member that can answer that?
