On it's face, it's controversial because the Florida law defies a recent SCOTUS ruling.


Kennedy v. Louisiana, 554 U.S. 407 (2008), is a landmark decision by the Supreme Court of the United States which held that the Eighth Amendment's Cruel and Unusual Punishments Clause prohibits the imposition of the death penalty for a crime in which the victim did not die and the victim's death was not intended.

I guess. I pretty much thought everyone agreed that rape, particularly child rape, is a heinous, violent crime.

I don't know that rape is controversial, even tho' Brand is.

If 'rape' isn't claimed in a timely fashion by the victim, then that introduces controversy. Yes. As it should.

The only thing that can be considered "controversial" about rape is that too often accusations are the basis for people getting their entire lives destroyed whether they are true or not. And if they are not true there is no hope to get back the life you lost

There are many reasons for delay.

Not least our Police and lack of confidence in them as per their poor record of taking victims seriously and very low successful prosecution record.

Child abuse.

Legal aid for custody cases in divorce was done away with here some time ago.

Except where allegations of child abuse are made.

Unsurprisingly, these have risen, a lot.

Correct.

And very difficult to prove after 15-20 years.

Russell Brand is accused of child abuse?

Women have a responsibility to other women to report rape. If a woman makes the choice, near the time of the rape, to stay silent about it, she is going to have to live with that decision. If she later changes her mind, the loss of credibility, real evidence and all the other problems caused by her delay, should not be taken lighty, nor dismissed.

I don't know why this is controversial.

If it's a child, that is whole other ballgame, and why I think the penalty should be harsh.

Its been said, however, that when penalties are so harsh, that rapists kill their victims with more motivation.

Exactly

Most of the time, these predators will "repeat" to the same victim multiple times. Why would they throw away that chance?

If they were going to kill at all, one would assume they would do that from the beginning. Knowing that when convicted, most child rapists don't last too long in prison before they are taken care of by others inside.
