FACT SHEET: Executive Order Protecting Americans’ Sensitive Data from Foreign Adversaries (June 9, 2021)

Today, President Biden signed an Executive Order (E.O.) to further address the ongoing national emergency declared in E.O. 13873 of May 15, 2019 with respect to the threat posed to the United States’ information and communications technology and services (ICTS) supply chain. President Biden revoked and replaced three E.O.s that aimed to prohibit transactions with TikTok, WeChat, and eight other communications and financial technology software applications; two of these E.O.s are subject to litigation.

Specifically, the E.O. the President signed today:

Enables the U.S. to take strong steps to protect Americans’ sensitive data: This E.O. revokes and replaces E.O.s 13942, 13943, and 13971. The new E.O. directs the Department of Commerce to instead evaluate foreign adversary connected software applications under the rules published to implement E.O. 13873 and take action, as appropriate.

That E.O. signed by Biden on June 9, 2021 is 14034.

U.S. Department of Commerce ICT Supply Chain

To implement provisions of Executive Order 14034, “Protecting Americans' Sensitive Data from Foreign Adversaries” (E.O. 14034), on November 23, 2021, the Department of Commerce proposed an amend its Final Rule on Securing the Information and Communications Technology and Services Supply Chain (Supply Chain Rule), which was published on January 19, 2021 (86 FR 4909). The proposed rule would provide additional criteria for the Secretary of Commerce to consider when determining whether the information and communications technology and services (ICTS) transactions that involve connected software applications present an undue or unacceptable risk (as defined in the Supply Chain Rule) to U.S national security, critical infrastructure, the digital economy, or the safety of U.S. persons. The proposal also makes conforming changes by revising the definition of ICTS to expressly include “connected software applications” and add a definition of “connected software application” consistent with E.O. 14034.

The comment period for the proposed rule ended on January 11, 2022, and in response to the posting, the Department received comments from individuals, trade associations, and industry members. These comments will be considered in the final rule.

The report indicates that Commerce is carrying out the investigation pursuant to its rules implementing Executive Order (EO) 13873 on "Securing the Information and Communications Technology and Services Supply Chain" (the ICTS Rules).

Scope of ICTS rules
