Had this been a group of white boys no issue about race would have even been brought up. If two minors, who can not give consent, have sex, then are both of them guilty, or only one of them?

11 year olds should know right from wrong.

There is a huge difference between a girl who goes looking for sex, and a girl who gets kidnapped and physically assaulted. The line between these two situations should not be blurred.

Young physically sexually developed kids don't have the emotional maturity, but they do have the drive.

To pretend that the female is always innocent and the male always guilty is sexist.

I don't know where you grew up, but where I grew up, teenage sex was common. The teenage pregnancy rate is evident of that. There were those girls who made the rounds. There were also plenty of girls who went after grown men. It is biology, and not that long ago, a girl getting married by the age of sixteen or earlier was common. While social morality has changed, biology has not.

Sorry, but I see a lot of sexist bigotry in our court system. Having been a victim of child custody court, I have a problem with very sexist attitude our courts take.

Tell me how I am wrong in seeing the Jr High boys as possible victims in this incident?

On the up side of things though, I have been laughing non-stop at some of these post! I love people. If only they could come to there senses after all the bickerring and argueing. Any 27 year old man who cant understand why it is wrong and illegal to have sex with an 11 year old deserves around 15-20 years in a state correctional facility to help him figure it out.

Thats very true. No matter what under 18 cant give consent. I think it maybe a differnt age in another though that might be like 17 or something like that. At anyrate they going down for it. I wonder what set her in motion to say she was rapped though. I mean wrong is wrong. none of them should have been having sex with her. It seems like she was doing her thing and somebody got her wrong THEN she yelled rape. I think theres a more complex story to it, but more along the lines of 11 year old rationale! but still, they are going down and they deserve it. some people learn hard lessons early on in life.

If the 14 year old in involved in a gang rape, yes. He is guilty too.

We are not talking about ONE 14 year old boy and his 11 year old girlfriend having sex and the poor kid getting his life ruined by an over zealous parent.

I would like to know why the delay in reporting too. Although just the fact that there is a delay in reporting doesnt mean she is responsible somehow.

Child molesters like to try to make the child feel responsible for what happened. Its just part of what they do. They try to make the victim feel guilty, and part of the crime so that the child doesnt report it. It could be like that, they might have initiated the whole thing in a way that made her feel as if it were her fault. They might have also threatened her afterward. 11 year olds might believe a 20 something year old who had just raped them who says they will kill their family or something.

No in the case of mutual desire (not consent) there would be no crime per se...

According to the the State of Texas the age of consent is17 (Texas Penal Code Section 21.11).

However , "...It is an affirmative defense to prosecution under this section that the actor...was not more than three years older than the victim and of the opposite sex...(and) did not use duress, force, or a threat against the victim at the time of the offence" and is not a registered sex offender Section 21.11 (b).

So according to this if there are two minors as you asked one could be charged if there was an age difference of more than 3 years or the sex was homosexual in nature.

I think in this case in particular we don't really know if there was duress, force or threat... that is why they were charged and not yet convicted to determin the facts.

The 14 year old guys could clearly make the choice to participate in a gang bang situation which could be considered force through intimidation by sheer numbers. She could have "agreed" to have sex with one or more then other's piled on figuring hell, why not she's a slut. Then perhaps she felt she couldn't say no for fear of being hurt...

All that remains to be discovered.

She was then taken to an abandoned mobile home, where the rest of the assaults occurred. Several of the attackers documented the event on their phones.

For those feeling sorry for these poor poor guys getting their lives ruined by devious and malicious 11 year old girls, it sure doesnt seem like they are such victims in this article. And apparently, there wasnt that much of a delay she was raped in November, it was reported to police in November.

The fact that you won't answer my question makes it clear you have a very sexist biased view.

There is no evidence these boys participated in a gang rape, and these types of accusations undermine the victims of gang rape assaults.

It is terrible that the girl is so young, but ruining the lives of these boys who got caught up in this is not justice.
