Yes it does matter if he was born Kenyan or a U.S. Citizen.
The original requirement was written into the Constitution because we didnt want a British citizen to take over the presidency. That would lead to a foreign government (England at the time) of having a major political sway in American policies.

I dont think Barry will dictate Kenyan policy but I dont like opening the door that anyone other than a U.S. citizen can be in such an influential position.

Would you currently want a French, Chinese or Russian born and possibly raised citizen to campaign and win an election? It could happen if we open the door even just this once.

He was a valid citizen of Indonesia and possessed an Indonesian passport. This negated his US citizenship. He must produce both his birth certificate and the original Certified Oath of citizenship he was supposed to have prepared on or around his 18th birthday when he chose to elect back his US citizenship as an adult. Without this document he is an illegal alien.

The case goes very deep. SCOTUS will decide based on th evidence or lack of it. nothing more. Take a pile of paper and file folders and print it all out before commenting.

DDAY Is Dec 1st!

Where is the evidence that he was an indonesian citizen?

Where is the evidence that SCOTUS has ordered him to do anything? Go the the website for SCOTUS and find where they have ordered the president elect to do anything at all.

Here is the link for SCOTUS

If SCOTUS had indeed ordered this then it would be on their own website. Instead all we can find is that SCOTUS denied the case a hearing. The burden of proof is on you.

I find this comment more than a little hilarious after 8 years of non-stop whining from the left about 2 lost elections. You guys have revised history and twisted facts for years now in an attempt to destroy Bush. Now that your guy finally got elected, the rest of us are just supposed to fall in to line?

If there is any truth to this, we need to seek it out. Thats all there is too it.

I think all of the frothing at the mouth from both sides of the politically deranged lunatics on ATS can stop now:

Berg, who appealed his case to America’s highest court, was told by Justice David Souter’s Clerk that his petition for an injunction to stay the November 4th election was denied. The Clerk also required the defendants (Obama, the DNC, and FEC) to respond to the Writ of Certiorari by December 1.

Everyone assumes this must mean Obama must meet the demands of the writ, when in reality all it has to do is respond to the writ.

The Supreme Court has only asked for a response from Obama'a lawyers. They have not asked for the birth certificate. Filing a response to a Supreme Court writ of certiorari is procedurally normal.

The rabid hysteria from Obama supporters and detractors can stop - a response doesn't mean the case will be heard, and there is no chance of any decertifying of the election happening. Calm down and breathe.

What about us people who are concerned that Obama wants to hand over the country to foreign bankers? What if we are concerned Obama will implement a carbon tax or take our guns? Do we have to be republicans? What if we don't support McCain? Can we still expose Obama then?

I am giving you a hard time - pull your head out of the sand already... or go back to sleep.

This thread has taken on idiotic proportions. Obama was born in Hawaii and all the rabbit wholes being dug here will not yeild anything other than the fact the guy is an American citizen. Get a grip.

This thread has been temporarily closed pending corrective action because the links are not of appropriate quality for this forum and the thread title is somewhat misleading.

Please be patient and hopefully we can return to a strictly factual discussion on this matter in short order.

Thread Re-opened.

While ATS maintains a neutral stance on this issue and all others, and welcomes members to believe or disbelieve the claims made in Mr. Berg's case, it was necessary to temporarily close this thread to deal with several misleading or easy to misunderstand items pertaining to matters of objective fact, as well as other issues.

Summary of action and note to thread participants:

Thread moved persuant to Posting Guidelines for Breaking News Forums

* Make sure it is a news story and not just an op/ed or some blogger's opinion. Invalid news items will be moved, closed or deleted.

A link to a blog which misrepresents a Petition For a writ of certiorari as being an actual writ of certiorari, and then claims that the setting of a deadline for the respondent to give a response regarding said petition is equivalent to a court order to produce a birth certificate, is not a valid news source.

Furthermore, as the petition was filed on October 30, this story was more than 48 hours old when the thread was posted, making it inappropriate for "Breaking News".

Here is Berg v Obama on the docket showing what has actually transpired thus far.

Thread title also changed to comply with Terms and Conditions

1). Posting: You will not post any material that is knowingly false, misleading, or inaccurate

All participants in this thread are cautioned against the knowing use of false or misleading information or politically charged rhetoric/bickering. In short, let's confine the discussion to things that either ARE true, or MAY BE true and keep it pleasant.

Thankyou.

the only reason i can particularly see there being civil unrest because of this, albeit in no small measure is from the minorities community. Think of it, the first black president elect, yanked from station on technicalities that should have been cleared before even the start of any of the electionary processes....you would almost think that such a situation would indicate the powers at be toying with the minorities representational influence in and amongst the politics of america....indeed wouldnt that just be a symbolic stab at the little man in america?

If Obama turns out to be inelligible (and I am supremely confident that he is elligible) there's nothing to stop his electors from all casting their ballots for someone else from a minority. In theory, the electors can pretty much throw democracy right out the window if they feel like it.

I think it'd be funny as hell if Obama turned out to be inelligible and the electors decided to put Charlie Rangel and Cynthia McKinney in office just to teach Berg a lesson.

Just want to extend a thank you to The Vagabond.

I, too, think this case should be discussed openly, and that there may be some validity to it. However, the constant posting of blogs that link back to other blogs, and the endless circular logic is getting tiresome.

Hopefully this will breath life back into a good discussion. I doubt that it will, however, because there is not going to be much to discuss until the case proceeds.

Correct me if I'm wrong - however isn't it a requirement for a person who desires to open an official campaign for the presidential nomination during an electoral year to supply certifiable proof of their ability to legally enter into such a position? That would include a document that undeniably validates their origin of birth.

Obama's bid for the presidency was authenticated and allowed to exist. Obama shouldn't have to publicize his birth certificate to the general public - as that document is sacred - as it is to all of us - and therefore those who had the legal right to authenticate his citizenship were afforded that right and in turn they allowed Obama to participate in the Presidential race.

That process never included the Supreme Court's interdiction.

He has. The Hawaiian State Department has already verified all of this.

It just isn't good enough for some people.

*Edit:

After a reread, I now see that is exactly what you were saying.

No, that is an opinion stated by the original judge in the original decision of Bergs suit. There is NO vetting process that is mandatory to prove citizenship before any election or even if you throw your hat in the ring!

What do you call the Hawaiian State Department's verification of the legitimacy of his BC?

I was also wondering if being a Senator would have done the same as far as verification, I can't walk across the street without showing my ID

As stated on at least 7 dofferant pages by many posters in this thread. What has been shown is the 'Live Birth' Certificate. Not the Vault Certificate that tells us the Dr. in attendence or if there was one. The Hospital, date, time and city. Thats the VBC that needs to be produced. All else are facimiles and can, and have been in the past by others, forged!!!

And you know that how?

The articles I have read all say "original Birth Certificate". What source are you using?

KITV

The state's Department of Health director on Friday released a statement verifying the legitimacy of Sen. Barack Obama birth certificate.

The state has received multiple requests for a copy of Obama's birth certificate. State law does not allow officials to release the birth certificate of a person to someone outside of the family.

Star Bulletin

State officials say there’s no doubt Barack Obama was born in Hawaii.

Health Department Director Dr. Chiyome Fukino says she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama’s original birth certificate.

Fukino says that no state official, including Gov. Linda Lingle, ever instructed that Obama’s certificate be handled differently from any other.

She says state law bars release of a certified birth certificate to anyone who does not have a tangible interest in it....

Biz Journals

“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate,” said Chiyome Fukino. “State law prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.”

Citing her statutory authority to oversee and maintain Hawaii’s vital records, Fukino said she has “personally seen and verified that the Hawaii State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.

So... source?
