The military fully falls under the command of the Executive Branch. So if it is the prerogative of the Executive Branch that someone is an enemy of the state that needs to be eliminated, how is that not an official act?

It would be an official presidential Top-Secret act, protected under the guise of "national security" (Thank you Patriot Act). Because of this SCOTUS opinion, it would be an "absolutely immune act".
