The misdemeanor charge of falsifying business records in the second degree says that a person is guilty when, with intent to defraud, he “makes or causes a false entry in the business records of an enterprise.” The first-degree felony charge says that the state must prove that the intent to defraud “includes an intent to commit another crime or to aid or conceal the commission thereof.”

Listing for paying a lawyer to obtain a NDA as a legal fee with the amounts accurate has no intent to defraud.

Trump wasn’t convicted of any other crimes.

And “the commission” was to obtain a NDA which is legal to do.

Obviously an appeal is coming and it would probably end up being successful but how long it will take I don't know.

I do know the Supreme Court can hear certain cases before they go through the process but I don't know the rules regarding that.

Cohen's payment to Stormy was ruled an illegal campaign contribution in his own case. However, that statute in this case does not require the predicate crime to be tried and convicted.

It only requires the jury to believe the predicate crime was mens rea for the falsification of documents.

Which has what to do with Trump presumed innocent until proven guilty with no evidence that Trump conspired with Cohen to commit a crime. With no evidence the Trump Organization tried to commit fraud when they paid legal fees to a lawyer for obtaining a NDA. NDAs used by numerous other politicians.

The prosecution presented over 200 exhibits of evidence and called 20 witnesses to support their case. In the end, it was enough to convince 12 jurors that Trump was guilty beyond a reasonable doubt.
