so 6 people decided he was guilty of insurrection and sued under the 14th to try and stop him from getting on the ballot.

last time I checked colorado supreme court and district court didnt represent the federal govt just the state... insurrection in this case would imply an attempt to overthrow the federal govt, a state cant say someone tried to overthrow the fed at random, they can say someone tried to overthrow the state govt.

The FED has to come at him for insurrection which they havent done because they know it wont stick.

eta: Honest question do you think if they felt they could get a conviction on treason/insurrection they would have messed around with all these other minor charges? a conviction would have permanently removed him from the board, problem solved.

You have to go to court to lose a lawsuit. the courts didnt even hear the evidence and kicked them out for no standing.
So since no formal decision was made there was no LOSS or WIN.

There are valid reasons why a case would be dismissed for no standing.

If your lawsuit does not explain how parties contributed to your loss, the judge might dismiss your lawsuit.

If your lawsuit does not include the party who caused your loss, the court cannot take action that will compensate you for your loss.

You go to jail for yelling "FIRE" in a packed theatre, or "BOMB ONBOARD!"....while on a plane.

IF what you say is inciteful, alarming or causing panic...free speech or not...it is illegal.

On January 6th 2021 Trump was the President of the United States of America.
As such he was the most senior law enforcement official in the land - bar none.
One of the main purposes of the Executive Branch - for which the President has 100% authority over all areas within - is to enforce the laws passed by Congress.
He was perfectly entitled to have election fraud investigated as part of the duties of his job.

The idea that he was not allowed to question the election results is entirely ludicrous.
It's like saying the govt cant investigate a crime because the people might get angry and riot.
That would be mob rule - as long as you have enough people who will smash things up if you get investigated for a crime, you'd be untouchable.

He did have the DOJ investigate. We also found out he had 2 additional companies investigate. He received an answer he didn't like.

We will see, but it does not seem to be legal to ask to find a certain number of votes, nor to work with outside sources to execute a whole plan that turned out to be fraudulent electors. That does not seem to be the way to actually find fraud.

If you believe there is a 'bomb on board' it is not in any way illegal to say so.
It's like saying that if you see piece of luggage in an airport left unattended and report it, you go to jail if people rush for the doors.

The only way your examples are restricted free speech is if you specifically yelled 'FIRE' in order to cause a stampede out the door and even then your chances of ending up indicted or in jail are minimal.

Trump was fully entitled to not just question the election but also have it fully investigated. In fact that was part of his job that he was elected to do. Investigate and deal with crime. He also quite clearly told the crowd to demonstrate peacefully.
There is no real case to answer here, so the entire indictment is nothing more than a political stunt.
If the SC do their job correctly, this indictment will be quashed.
