Hogwash...the 14th amendment clearly invests in congress the sole power to address insurrection.

This has been done through the impeachment process in which insurrection was addressed, and failed to convict.


Thinking that because congress didn't convict on the insurrection charge, oh hey let's use the judicial system instead, completely over ruling congress.

Nobody is trying to overrule Congress.

The Senate didn't convict Trump, after the House impeached him, because they decided Trump was ineligible for impeachment, seeing how he wasn't president when the Senate got the case. According to McConnel, they didn't even consider evidence that he might have incited an insurrection.

McConnel made a long speech about it, and the ways Trump could still be held liable for his actions and culpability of Jan th's events.



I don't know why y'all are so surprised that it's all happening now.

Has he been charged with insurrection?

has he been convicted of insurrection?

if the answer is no, how can they apply the 14th?

Also like I said, when actual rebels against the fed were allowed to run for and hold office after the civil war it kind of shows the lack of teeth in the 14th.

When you can disqualify political opponents by simply being the opposite political party and "declaring" or other extra-legal means calling them criminal, you wind up with a "if we have the votes, we can disqualify" political party action. I thought the judgment to make in this case is whether or not Trump committed insurrection.

Looks to me like this decision is the due process.

Due process is a requirement that legal matters be resolved according to established rules and principles and that individuals be treated fairly. Due process applies to both civil and criminal matters.


Some random judge appears to have said he thinks it was insurrection there was no discovery, no presenting evidence no legal decision made, so no due process. (this is why trumps numbers are rising among groups of people that feel alienated by the system they seem him getting screwed as well)

(J6 kangaroo court doesnt count, I mean actual legal due process)

We'll let the Appeals Court and the Supreme Court rule on the "Presidential Immunity" extent first. That will set the tone for all Trump-related legal discussions thereafter. (And if Biden can face the reactivated federal firing squad in 2025.)

There was a trial. Not a criminal trial. A dismissal trial.
