Well, the Brandenburg case, which says that even advocacy of violence is protected unless the speech is directed to and likely to incite imminent violence.
So, he tells his followers to "fight" more than 20 times, he tells them where to go immediately following his speech, he was aware some in the crowd had weapons as was noted in testimony. The Hess case states that the encouragement can be "implicit" but does not have to be "explicit".
I mean he can argue it's not imminent because it was a 20 min walk to the Capitol or whatever and it's not really his fault his followers thought he was telling them to actually fight.

Well, I mean I don't argue the stupidity. People argue that an old guy in fatigues convinced these people to break into the Capitol and beat cops with flag poles. It also lends credence to the fact that if they actually believed his phrase was literal, then it makes sense his faithful could be stupid for believing after being told over and over again starting months before the election the only way he would lose is by fraud, that ballots were "dumped in rivers", that even though there has been no concrete massive fraud, they still believe there is because he tells them that, every single day. Makes sense they keep sending him money, even though reports show he's enriched himself and his friends with it. Makes sense they are threatening the judges he rails about every day.
You would think though, if the President was aghast at what was occurring he wouldn't have sat for hours, refused all the pleas from everyone in his orbit, calls from allies who were scared and huddled in congress and he would have called in the help they were seeking. I mean instead of inciting them further with his Pence tweet. He could have told them, this is not what he meant for them to do and it was horrible. He could have made just one phone call for help for the police and congress.
