An insurgency orchestrated by Pelosi in collusion to steal an election from a duly elected President.
He scared them that much.
And still does.
So if anything the counter electors and the peaceful protest as per 1st amendment rights that sought remedy for the theft could be accurately assigned as a counter insurgency considering D.C. is a foreign entity.

This is a civil trial. It does not require criminal charges to have been brought forth and convicted.


Actually he was found guilty of wrongful death in the civil suit.

Loophole or not, is the Supreme Court not bound by the 14th Amendment?

And, since there has been no evidence found that Biden lost, how does this contesting of the election result qualify as anything other than an insurrection.

Who called it a peaceful protest? The killing of the protester was unfortunate and not needed. There were two capital police standing right behind her when she was shot. I also didn't say smashing windows was peaceful. You need to reread my post.

I’m not joining any side.

I’m interpreting 14th Amendment.

Here is the 14th Amendment in case you are unfamiliar with it.

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

Again, it is a stretch to qualify 1/6/21 as not being an act of insurrection or rebellion against the constitution without being able to show evidence of election fraud. The results of the election were clear. Show me the fraud and I will change my forecast.

So I will be surprised if the Supreme Court rules in Trump’s favor.

Again, she stayed her order pending rulings from the court.

Are you aware that in the other cases Trump is not the respondent? Those lawsuits are against the SoS of those states with the intent of having the courts rule they must not include Trump on the primary ballot.

In the Maine case, the complaint was made directly to the SoS. But she is still deferring to the courts. Now, if Trump refuses to sue the SoS to overturn her decision then the decision will stand.

The SOS is the ultimate authority on elections in their state. They have the final say on whether or not someone has met the qualifications to appear on a ballot.

That said, we live in a three branch government world. If someone doesn't like a decision an SOS makes it can be brought before the judiciary. Or the legislature can amend the state constitution and give the powers bestowed to the SOS to someone else.

If her order is unconstitutional the courts can overrule it. If the people of Maine disagree with her order they can pressure their legislature to pass a new amendment that limits the powers of the SOS. If the numbers aren't there to pass such an amendment, the people of Maine can elect new representatives that align with their desires.

Such is the nature of our form of government.

Unlike Trump, she at least acknowledged her order would be controversial and challenged in court and issued an immediate stay.
