A APPOINTED posistion is what is specified in the 14th amendment. It says ELECTORS of president,and in those words ELIMINATES the 14ths power over trump by excluding him from the mentioned offices. WHy? Because the president is ELECTED into the presidency,not appointed.

The president has to be IMPEACHED to be removed. Also CONGRESS is the only ones who can determine insurrection legally.

And laws written AFTER the civil war have to be considered in modern cases. the COTUS is not set in stone.

CORNELL LAW says a trial MUST be given since it is a federal crime. The president being president at the tiem should had been IMPEACHED. now as a private citizen,he must be given a trial.

If the states wanted to certify a new slate of electors, they could have done that without Pence.

That's how the state of Hawaii handled it in 1960. The Governor certified the democrats electors after a recount, and VP Nixon accepted them as the real electors.
