That was part of the NDAA 2021 bill which Trump vetoed but both House & Senate overrode and became law on Jan 1, 2021. The bill included a provision to require the executive to consult with Congress before invoking the Insurrection Act of 1807.

H.Amdt.833 — 116th Congress (2019-2020) Description: An amendment numbered 3 printed in House Report 116-457 to require certifications be made to Congress when the President deploys active duty military within the United States during civil unrest by amending the Insurrection Act in Title 10, Chapter 13 of U.S. Code.

H.R.6395 - National Defense Authorization Act for Fiscal Year 2021

Specifically, Page H3329 - do a keyword search for "Insurrection"

I didn't read it all but appears Congress now has final say on invoking Insurrection Act based on...

(4) by adding at the end the following new subsection:
``(b) Certification to Congress.--(1) The President may not
invoke the authority under this section unless the President
and the Secretary of Defense certify to Congress that the
State concerned is unable or unwilling to suppress an
insurrection, domestic violence, unlawful combination, or

I don't remember this being discussed but please remove if so. During the VP debates there was a heated one between Harris and Warren. At the time Harris was really arguing to have Trump removed from Twitter. However Warren did not agree at all. In fact her position was concern over the big tech companies and the need to control them and even break them up. Also she was against taking any campaign contributions from them.

Section 230 has been used to protect on line media companies for being accountable for content published by users so what are they so afraid of with Trump tweets? They are not libel.
Another argument is that they are private companies and they get to choose who gets to use their services but what happens when companies are so big, so powerful, that they control the direction and all content

Yes funny you should say that. His sent out two tweets asking everybody to go home with love and peace in their hearts. They where taken down by Twitter. Unusual behaviour. They normally just censor them. Now it makes more sense.
