Andrew McCarthy explained on the Limbaugh segment that the Epstein operation, being interstate, falls under federal sovereignity for jurisdiction. Thus local venues for prosecution of the underlying offense have no bearing outside of being construed as double jeopardy for a federal crime. That's his take, I'm not a lawyer...

Not quite right. State and federal courts have concurrent jurisdiction over actions / conduct that constitute a crime under either state or federal statutes.

There are crimes that are federal only. But kidnapping and bringing someone over state lines (like may be alleged against JE) is a federal crime because the fed has jurisdiction over multi-state conduct; and the kidnapping part is also state crime, because not all kidnapping victims are brought over state lines. A person can be tried for both, but usually isn't if they're convicted of one and get a substantial jail time, to save resources.

So long as *all* the elements needed to prove the crime are different - state and federal - a person can be tried for the same conduct/actions in both federal and state court.

For example: killing an FBI agent who is doing his job is a federal crime because the victim is a federal employee. But killing a person is a state crime. They're different because one element: whether the person is a federal employee doing his job - is not present in the state statute.
