Donald Trump's verbal outbursts during the writer E. Jean Carroll's emotional testimony about threats of death and rape she received prompted a judge to warn the former president that he could be kicked out of the courtroom.

I mean, this is written like the intro to a novel. So, the opposing lawyer decided to chime in during a break and say the jury could hear him...so...why not bring it up while it is happening?


Carroll took the witness stand Wednesday morning. During a break in testimony, her attorney Shawn Crowley complained to the judge that Trump was making audible comments that the jury could hear. Later on, Crowley said Trump continued to comment on Carroll's testimony despite Kaplan's warnings to remain quiet. She said she heard Trump remark, "It is a witch hunt, and it really is a con job."


And, How did a lawyer know the jury could hear his comments?

Further, so the judge decided to continue to interrupt during cross....


Carroll's cross-examination by Trump attorney Alina Habba was repeatedly interrupted as Kaplan admonished her for improper courtroom procedures, at one point telling her, "Refresh your memory about how it is you get a document into evidence.


and Carrol can do no harm...I mean....why would she delete a threat?


Late in the day, Carroll acknowledged that she may have deleted some of the threats she received via email. Habba quickly asked for a mistrial, saying Carroll may have violated a subpoena by doing so. Even more quickly, the request was denied.


This is not about Trump. This is about what the courts could do to anyone.....

Habba grilled Carroll during cross-examination on why she deleted messages with death threats. Carroll said she did so because she did not know how to deal with them. Habba asked the judge for a mistrial on that matter, but was denied. Kaplan also scolded Habba for reading a transcript of a deposition that she had not provided to him.

Habba found the section of the document and provided it to the court clerk. ‘We are going to do it my way in the courtroom, and that is all there is to it,’ the judge said in a raised voice.

Two separate recesses had to be called so the judge could instruct Habba on basic trial procedures. She didn't know how to impeach a witness and she didn't know how to enter evidence.

Things aren't going much better for her today.

Habba isn't a trial lawyer. It's not the kind of law she practiced before Trump hired her. By all accounts she's a very good paper lawyer. But that clearly doesn't translate to being a good trial lawyer.

Trump would've been better served by keeping Tacopina on as lead counsel for the case.

It certainly would've been a cheaper option for him. The actions of him and Habba have done nothing to ingratiate him to the jury that will decide punitive damages.

Ted Boutrous, one of the premier litigators in the country, has speculated Trump could be on the hook for as much as $100 million.
