Judge rules Trump has to stay quiet and not defend himself in court - Carroll Case

This is beyond insane. The things they are going with the gag orders, and the fines is enough. Telling him in NY they did not want to hear his side....now this.

Judge Lewis Kaplan ruled late Saturday night that legal representation for former President Donald Trump cannot argue that he did NOT rape E Jean Carroll. The ruling came during a late Saturday filing in advance of a trial set for Jan. 16 that will determine defamation damages against Trump after a jury found Trump liable for sexually abusing Carroll but did not find evidence to conclude that he raped her. Judge Kaplan wrote: “Defendant and his counsel shall not offer any evidence, conduct examination, or make any argument relating to Carroll II jury’s determination that plaintiff had failed to prove that defendant ‘raped’ her within the meaning of the New York Penal Law.”

This is completely nuts. So, he cannot say he did not do something he did NOT do and was NOT convicted of??????

I do not care where you stand on him but as a country this is setting such precedent the legal system is screwed for decades.....

More guilt by association and diminished equal protection and swatted 1st Amendment. Also maybe a 5th Amendment violation. They're testing everything and overloading the appeals courts and The SCOTUS. ☢️

That E Jean Carroll case had no direct evidence and no forensics evidence. All hearsay and speculation and assumptive conclusions. 😀

He had the opportunity to defend himself during the trial. Carroll claimed she was raped, and said that she still had the soiled dress she was wearing that day, that it had Trump's DNA on it. The court said Trump could refute her claim by submitting a DNA sample. He refused, so the judge said he couldn't revisit the rape assertion since he refused to submit a DNA sample.

Isn't this suit not about the incident he has already been found guilty of? Isn't this suit about his continued defamation of her AFTER that first trial was concluded?

So this trial is not about his guilt or scope of the sexual abuse but rather simply on whether or not and to what degree he defamed her. So defense concerning his innocence or guilt of sexual abuse has no bearing on this case at all.

Am I wrong here?

But, then again, we are all well aware that when it comes to Trump he is guilty until proven innocent. That whole him living rent free in yalls minds really gets to you doesn't it?

I guess we can just go around and claim someone is guilty of doing something and then, no matter what they say, they are guilty of it without trial. Good to know

Trump is being sued for defamation, again. Every time he claims Carroll is lying, he's defaming her.

He has his day in court. Carroll claimed she had DNA evidence that proved Trump raped her. Trump asserted his 5th Amendment right to withhold his DNA. In civil court, that omission can be used against a defendant.

sort of. he is being told he cannot say anything about being innocent or her being a lunatic. Based on Trump's actions his entire public life, he's a massive womanizer, would cheat on his wife in a second, but not a rapist. Remember, when you are famous, you can grab em by the pussy, they just let you.

The only reason this case wasn't laughed away is 1, it was Trump, and 2. it was in NYC.

Did she claim rape and report it when it happened?
Is there a police report?
Wouldn't the dress be in evidence?

She came forward about Trump, with a group of women during the "Me Too" movement. Trump singled her out, and started attacking her during the 2016 election campaign, while all that Access Hollywood stuff was also going on.

E Jean Carroll then filed her defamation suit and won.
