the thing with secrets in the us or uk is common law creates leaky bucket apparatus, secrets don't stay secret very long.. its a means to prevent corruption..

Not really. The Prosecutor can do anything he wants during a Grand Jury hearing. That's how the statement "I could get a Grand Jury to indict a Ham sandwich." came about.
Now if they were to use the edited phone call during the trial, that would be different.

Te suprem court could say they got a indictment on false pretenses though. its a possible outcome.
