- 9 justices hold regular conferences from late Sept to late Jun to perform this task
- from roughly 8,000 petitions - select about 75 cases for the year
- 4 or more justices vote to take case, added to docket; otherwise, review denied

vote if they are dead: ‘Appointed for life, not for eternity’

- The SC agreed in an unsigned opinion with no noted dissents
- allowed a deceased judge to exercise the judicial power of the US after his death.
- SC says - federal judges are appointed for life, not for eternity,
- 9th Circuit argued judge fully participated & authored his opinion in a footnote
- SC says problem is the opinion was issued 11 days after he died
- understood judges may change votes up until the moment decision is released.
- NOT LEGAL if not endorsed by “majority of living judges at the time of issuance.”

Supreme Court cases, October term 2020-2021
- Besides the potential election issues that may come before the SC.
- As of Jul 13, 2020, the court had agreed to hear 31 cases during 2020-2021 term.
- Of those, 12 were originally scheduled for the 2019-2020 term but were delayed
- Supreme Court will begin hearing cases for the new term on October 5, 2020.
- If SC follows normal schedule, private meetings to pick cases start Mon, Sept 28
- RBG passed away on Sept 18 = 11 days from start
- SC unanimous decision clearly nullifies any idea to use her notes or past opinions
