Now you’re asking a good question. However I think he can enforce the agreement without rehashing the old case. The problem before the court is the violation of the NDA. The NDA is a result of the already tried case between Donald and stormy. They aren’t there to rehash the merits of the old case but to enforce the agreement that resulted from it.

It is a problem because he paid for her silence so he could run for President , he tried to lock the cupboard door to hide an obvious skeleton then his layer claimed he , not Trump , paid the money from his own pocket.
A court case will no doubt look into that claim as it would be part of the defence which could lead to Trump being caught in a lie.
