It's be more akin to shooting an intruder in a state which doesn't recognize any sort of castle doctrine. Pepper spray being illegal there, it's a legal matter. Being sued by said intruder is a civil case.

yes there is the *LAW.* (all hail and Worship the law...) Fact is; idiotic laws like this make good people into criminals. This law is not good. Europe has laws like this but sometimes legalizes drugs and drug related problems. That law (that the girl ran afoul of) is bass ackwards.

Also what the hell happened to prosecutorial discretion? or the individual policemen's ability to excersise discretion in enforcement to ensure the public good?

She is not blamed for defending herself.
She is bla,ed for using a weapon.

Had she used a small hair spray it would have been legal to carry and the law on self defense in Denmark states that you can use appropriate force.

She would definitely be allowef to bite. And if the jocular gave way in rhe process it would be frowned on but probably not procecuted.

There comes a time when the law is so out of step with reality that it must be changed.

i mean police are supposed to be able to decide to ticket or not under special circumstances. For example a citizen is stuck at an intersection at 2 a.m. with no traffic. The traffic light is not turning after some 5 minutes...(perhaps the programming is glitched or there is a pressure plate that wasn't hit right) the citizen's car is in the left turn lane. there is no traffic anywhere. The citizen executes either a left turn on a red light or turns right across lanes to his or her right. A policeman happens to see it. The policeman can technically cite the driver for several traffic infractions (some serious.)

9 out of ten policemen will not cite for these violations if they are aware of or made aware of the problem with the light. more than 9 out of 10 actually. A rookie might cite or in a town where there is a known traffic enforcement for money's sake trap. but most police would not cite what is technically a violation of law if the action was reasonable under the circumstances. E.G; wife is in labor and man is driving over the speed limit to the hospital. typically the police will stop find out what the deal is and elect not to cite and sometimes will escort to the hospital.
