It is up to the BANKS to assess their value prior to making the loan.

Most banks have an expert appraisal done by a reputable 3rd party. But the responsibility and the onus is on the banks to do the appraisal however they see fit.

Sadly this damages any idea of a fair justice system. And I hate to break it to everyone but the minute that justice is no longer blind then that in itself is a tyrannical government. That was the first thing Hitler had to change was German law. He did that by scaring the German people with the Reichstag fire. This allowed laws to be passed suppressing the rights in the name of terrorism of the people and gave him total control.
