BREAKING 🚨 Supreme Court rejects effort to remove President Trump from the ballot.

Congress, not the States, is “responsible for enforcing Section 3 against federal officeholders and candidates.”

This was bound to happen, only idiots will believe states have more power than the darn congress.

Got to love the supreme court

In reading articles -- a question was asked.

Why would SCOTUS -- offer up more than they were asked?

The job of the Supreme court Annie is to interpret the constitution, is what we all know as checks and balances, states with their state attorneys and circuit courts cannot make independent interpretations of their own.

States are bound by Congress, the constitution is for the supreme court to interpret and if congress does not like something that is their job to legislate on it, no the states.

Is actually simple, I took constitutional law in college as an elective, I just try no to argue about these things, because everything is ongoing until the supreme court steps in.

I am aware.

I am aware.

However, it is not customary for SCOTUS to offer more than they've been asked.

Four say they did. The three liberals and one conservative.
Five say they did not. Four conservatives and one middle ground (the Chief Justice).

We don't know the mind of the SCOTUS, but it's my guess they said a bit more so they don't get inundated with more nonsense like this case, all wanting to do the same thing but at different levels. Nipped it in the bud. That's just a guess of course.

I'm thinking ex post facto would apply.

But I'm not surprised they are still concerned with Trump rather than doing the work of their constituency.

From your source that leads to the bill:

This bill establishes a civil action through which an individual may be disqualified from holding office under Section 3 of the Fourteenth Amendment of the U.S. Constitution. This includes an individual who has engaged in insurrection or rebellion against the United States or has given aid or comfort to the enemies of the United States.

They will still need some mechanism to prove beyond a reasonable doubt that Trump engaged in an insurrection.

Oh I already know if he wins they will attempt to impeach him for the third time. Unless Republicans gain a majority in both houses then game over.
