You need to understand this is a civil suit; not a criminal one.
If he really committed fraud, it'd be a criminal case. Do you know why people bring civil cases to court? Because civil cases DO NOT require empirical evidence; they also accept hear-say testimony.
Civil court is not evidence based; it's feelings based. Well we "feel" you committed fraud; so we're gonna levy a judgement against you.

In civil cases, the plaintiff has the burden of proving their case by a preponderance of the evidence, which means the plaintiff merely needs to show that the fact in dispute is more likely than not.
A preponderance of evidence is just an acumulation of people saying the same thing. "Merely has to show... it's likely."
Do you understand the evidence standard of civil court? You can gas light and win civil cases. This is why criminal charges do not exist; because criminal cases can't be gaslit; proof it's likely doesn't cut it; you need to prove it happened beyond a shadow of a doubt to get a criminal conviction. They can't do that; that's why they are in civil court. They are trying to take his money to remove his ability to defend himself.
How do you prove I overstated my assets value? Value is subjective; I could have properties appraised by two appraisers and get two different valuations.
A smart business decision would be to use the higher apraisal. I guess that's "fraud" to NY. I don't have to believe an appraisal is correct. They often aren't.
You can be charged with something criminal; be aquitted because of a lack of evidence, and you'll lose the civil case, because you were tried criminally -- despite the fact that you were acquitted. They say it's "Likely, we just couldn't prove it -- summary judgement."
Nobody should be able to be found guilty of anything without evidence, people are liars. If you can't prove I'm guilty, then you're likely just gas lighting; no judgements should be levied based on pitchfork mobs... That's disingenuous at best, and can be weaponized at worst.
In this case; it's weaponized.
