I am not making assumptions. I am gauging what I believe, based on a fair amount of litigation experience as an C-level executive with a JD, what this particular jury doing a particular thing in 3 or less hours suggests.

For one, it suggests, whether prior to deliberation or very rapidly during deliberation, straw polls were conducted by the jury and there was not, and never was, a majority of the jury in favor of the rape element of the complaint.

3 hours is fast for a jury. The damages are pretty low relatively speaking. Maybe anything happened!

But people hire people to evaluate jury behavior, it’s a part of any major civil litigation (a 7 figure claim would not generally trigger plaintiff and defendant engaging jury consultants — it would just balloon costs over a relatively small dispute compared to what usually makes it to a jury).

Based on the damages, the liability the jury found, and the speed at which they found it, it is a very reasonable hypothesis that:

1) they did not seriously deliberate the rape claim
2) there was probably already a majority voting in favor of the defamation claim (at the latest in the 1st or 2nd straw poll — but possibly before deliberations.
3) the sexual assault and battery claim appears to have been the most deliberated, and is the most likely claim where jurors made a compromise with each other.

Hire a jury consultant, they’ll tell you the same.

Makes the verdict pretty obvious on the rape claim.

What a tortuous rationalization. Instead, ask ‘what would you have done there if you were in Trump's shoes, knowing in your own mind that the allegation were true?

Answer: skulk at home, refuse to cooperate with either the court or his lawyers, refuse to provide a DNA sample. Which is exactly what he did, because it was either that or show himself to be guilty.
