Notice the key word "involuntary" there.
I'm all for cutting somebody some slack if there is any doubt at all as to intent.
Run a stop sign, well, maybe they didn't see it. Maybe they were distracted, whatever. Same for speeding, taxes, and a myriad other crimes.
But when you go around tazing old people, that is 100% intentional. I can't imagine any mitigating circumstances. That person made a conscious
decision to get a tazer, find an old person, and taze them. There is no, "Oops, sorry. I didn't mean to." Knowing the effects a tazer can have on
someone that age, I see it as no less than attempted murder.
And for the record, I would press for attempted murder charges if the person doing the tazing were law enforcement as well.
