Still doesn't say that. He sat down and reloaded in case there were more, don't mean he knew for sure there was more.

Not the one in the OP it don't.

In the OP's article it links to a previous article....

www.cbsnews.com...

Prosecutors say as Brady descended the basement steps, Smith shot him in the chest, then in the back while Brady fell, Wartner said. Smith fired a final shot into Brady's head, the bullet passing through Brady's hand, Wartner said. Smith put Brady's body on a tarp so he wouldn't get blood on his carpet, dragged it into his workshop, reloaded his rifle and sat down again, the prosecutor said.

A few minutes later, Kifer walked down the stairs and Smith shot her

If all this is true, you have to wonder what kind of moron that girl was.
Her thief boyfriend goes down... there are gunshots... then she goes down.
It sounds like an actress from a teen scare flick.
Everyone watching the movie shouts, 'Don't go down there".

Then again, they were thieves, can't expect that they had a lot going on 'upstairs'.

They were also cousins so you can draw your own conclusions about their upbringing from that. What a model family!

You said, in reply to me stating that he was so afraid for his life that he got a tarp to move the body for fear of bloodstains....

Maybe he thought it was a lone nutbar at first and it was over?

If he thought it was a 'lone nutbar' then why would he sit back down again? Your not making much sense mate sorry.

No I wouldn't move them to avoid getting blood on my carpet because I have tile.

If a punk tried to break in to my home he will be met with my shotgun and if by chance the punk is still alive after getting hit he will be begging me to finish them off.

Psychopath? No. Just the king of my castle protecting my queen.

Whoa.
I missed that.
I thought that only happened in West Virginia.

I don't feel one bit sorry for these two. They got what they asked for. Too bad it didn't happen in Texas.

As has been pointed out multiple times by several posters in this thread - shooting someone in self defence of your home is OK but then administering killshots after they were already down is murder, pure and simple.

Good luck protecting your 'Castle and Queen' while serving a sentence for murder.

Yes or no, Nick Brady was 17 years old, was unarmed, and was shot by a man who had time to deliver a shoot em up movie line along the lines of "you're dying B****" before completing the execution?

People are missing the point, the cops are that brutal in America now that if he had called them, they'd probably have came out an hour later after the burglars had left then shoot the old man and/or his dog....

I don't think anyone should execute people for wronging them but if its the third time and your an afraid old man.... The whole notion of this being premeditated shows that this old man was thinking a lot about these break-ins, it was bothering him... He was afraid and the system that people keep going on about, let him down the first two times.

The fact that these two kids were well known should show that if the police had done any real police work after the first two incidents, then they would probably have found them from the descriptions....

Police failure leads to civilian action, case and point being this one highlighted here....

The real stupidity here is the 65 year old who recorded it. At least he was smart enough to make sure there was only one story to tell after the lead stopped flying; but recording it and having evidence that can be presented in court incriminating yourself is just plain dumb.

The overall process indeed was totally disproportionate for the crime. Sure enough, the kids did break in, and for a moment did present a threat and danger. However, conducting a execution is not equal to self defence, and use of force always needs to be balanced to the level of threat. As the case reads, it is really hard to see any threat from these kids as they were down. He just wanted to see them dead, and he wanted to see end to the nuisance these kids produced to his property. And for that, for sure, he will go for a nomination for murder in 1st degree.

That takes it from self defense to premeditated murder. THATS what.

They shouldn't have been in there, if you don't want to get shot, don't break into houses in America. Simple.

Clearly you haven't read through the thread properly because if you had then you would know I already said the kids were doing the wrong thing. NOBODY is questioning that at all. What is being questioned is the extreme use of force by the owner that went far and beyond just simple 'self defense'.

Hes guilty of murder plain and simple....there are degrees of culpability...and when he shot the kid in the face the second time it changed to plain homicide.....
regardless of how the majority feels im stickin to that statement....no longer a threat...the next shot is murder....when the threat is down it is time to click on the safety and call the police.....they'll be there when they get around to it.....
If you arm a society....then the citizens must be capable of sound moral judgement... tempered with wisdom and mercy.....
To be an armed citizen it is nessessary to be of sound judgement and in control of your self.....so few really are......

Because he was an old man out of breath as evidenced by the heavy breathing on the tape? Sat down to catch a breather and reload in case more were coming.

Nope. As far as I'm concerned you leave your human rights at the door when you break in to someone's house. I'd have preferred he videoed the whole thing and their parents be made to watch it. See how that works as an example to other scum.
