The Constitution states only one command twice. The Fifth Amendment says to the federal government that no one shall be "deprived of life, liberty or property without due process of law." The Fourteenth Amendment, ratified in 1868, uses the same eleven words, called the Due Process Clause, to describe a legal obligation of all states. They needed Mike Pence. He was key to their plan. Pence wouldn't cooperate, so, their plan failed.
Then why have Steve Bannon, Roger Stone, Gen Mike Flynn, John Eastman all not been charged with the Insurrection Act?
Eastman was charged on nine counts:
Violation of Georgia’s RICO Act
Solicitation of violation of oath by public officer
Conspiracy to commit impersonating a public officer
2 counts of conspiracy to commit forgery in the first degree
2 counts of conspiracy to commit false statements and writings
Conspiracy to commit filing false documents
Filing false documents
