The prosecution is trying to get a lesser charge of third-degree felony murder based on the felony of child abuse that resulted in death.

(My take on that is they are hoping the "child abuse" part will sway the all woman jury.)

I asked this before but didn’t see a response…..

What is the difference between changing the charges mid-trial and double jeopardy? I don’t see much difference. Why does the prosecution have the ability to change course simply because they failed to meet the burden of proof in the original charge? Is this a common practice??

They are gonna try to pin anything on Zimmerman at this point.

They know if Zimmerman gets off scott free most major city's will see riots.

In the end it all boils down to don't put your hands on other people or you might end up dead.

Sadly, it is pretty common, to try and cover their ass with lesser charges, just in case they fail to prove the one they are after. It's BS if you ask me, and I am not sure how that ever made it into the courtroom in the first place. One of the many reasons our prisons are so full, and that prosecutors are allowed to overshoot to make themselves look good and advance their careers.

Looks like they are going to list 2nd Degree Murder on the charge list for the jury, but the list the lesser charges after it.

I hate that.



I think they should just go with the 'no seatbelt ticket' and be done with the whole thing already.

I have seen it done before. But in most juries I was on the lesser charge was present from the word go. I really feel the prosecution is just trying to get anything to get Zimmerman behind bars.

Absolutely.

But then, HOPEFULLY, the Child Abuse charge connotates a disrespect to the mother's; they have children and they know that being accused of child abuse is something Serious that they don't play with.....

Allegedly, in Florida, it is to protect your civil rights. Thats BS.

In reality, it almost guarantees a conviction if SOME sort. This is why Florida's prisons are overcrowded, and I believe their current time now is 3 or 4 to 1.

They have a schedule of lesser included charges, so, if a jury doesn't find you guilty of something, they have to go down this list and check off things till they get to something that they think applies.

There is no, Murder 2, guilty, not guilty, or aquit anymore. That is what the defense asked for.

Instead, they are including not only adult charges, but all the child/minor charges they can link up.

I think she will throw out the murder3 child abuse. It requires intent. She didn't seem to like or agree with that, and hinted as much.

The FOX commentators have brought up a point that I was thinking...

the judge mentioned to West:

"If I have made a mistake, then you can SURELY appeal and get this overturned."

Hmmm...was this her plan all along? So that the riots are "not on her head"?

She recessed lunch on it, said she will look it up. She questioned the word "intentional", stating it was not on the Information. (Indictment)

She told West to work on over lunch.

No ruling yet on the third-degree murder charge (child abuse). Arguments will continue when court resumes at 1pm EST.

That is my thinking, she doesn't want to be responsible for anything that may get GZ an acquittal. So she is doing what she can to help the prosecution and then when GZ gets it overturned on appeal it is on some other judges head.
