Those aren't the punishments unless you are tried and convicted as an adult. Also, the first line clearly states that the judge can modify the sentencing guidelines.

She also broke the law by getting drunk underage and passing out. Was she charged with underage drinking? She also broke the law by disclosing information sealed in a case. She should be charged and tried for it.

The boys aren't right, but they were tried, found guilty and were punished. What she did was add her own personal additional punishment over and above what was agreed to by the judge, the defense and the prosecution acting on her behalf.

You might not like it, but she did it.


Victim blame is NEVER in order. I am so disgusted by some of the people here. Tell you what, if you ever have a daughter, and she gets drunk, and raped, lets just say its her fault, k?

You can blame her for the things she did that were wrong. To imply that it is in ANY way her fault that she was assaulted is the exact reason why people continue to get assaulted. So congrats to you all who justify this-next time hopefully its someone you care about.

I have 4 daughters and they aren't stupid enough to put themselves in that situation.

They follow the laws and they follow the rules... and I will be darned if they have somehow avoided passing out drunk and getting sexually assaulted because of it.

You wear your agenda and your personal experience a little too boldly on your sleeve...

My agenda? You mean to NOT BLAME THE PERSON WHO WAS ASSAULTED?

Seriously...i weep for the future....one can only hope your daughters never find themselves in this type of situation, but if they do, I fully expect that you will say it was their fault.

No more damaging than saying a its a girls fault that she got raped. Anyone who blames the person who got raped, needs to experience it. Only then will you realize how far gone you are.

They never would because of good parenting teaching them not to go to parties, drink underage and pass out.

As I said before, nothing the boys did was right or excusable... but our princess here is also guilty of underage drinking and criminal defamation of character for violating the court order.

I think if more people with daughters thought the way that I do - which is that the children be brought up not to disobey the law and to be protective of themselves so as not to put themselves into vulnerable positions - as well as being brought up with the knowledge of self defense and the knowledge of what kinds of risky behaviors can put them into situations where they can get hurt and how to avoid them - then we wouldn't be having this conversation.

She should have never drank underage. They never should have assaulted her. She never should have violated the court order. None of their hands are clean in this.

There is nothing, EVER, than ANYONE can do to INVITE rape or sexual assault. If I want to run around naked with a sign that says "my penis tastes like chocolate", that still does not give ANYONE the right to come and touch it.

Again, justifying sexual assault is the exact reason it happens so much. "She was asking for it by the way she dressed"; "she got drunk so she deserved it", "she was acting slutty"...in what world do any of these things JUSTIFY A RAPE?

Well, as I was saying before being personally attacked...

She really blew it by breaking the terms of the court order. Justice was done in a court of law. It is not this girl's right nor the right of anyone else to break and disobey the terms of the court order.

Like it or not, if we just start allowing anyone who wants to violate a court order to do it, then every restraining order in the US becomes immediately uninforcable - not to mention every other court order.

No of course not. Good parenting means kids never ever break the their parents rules.

Just pretend for the sake of discussion the possibility your daughter went to a friends house. Drink too much. Went unconscious. Was sexually assaulted and videotaped. You make it sound as though you would ground her because she was drinking....

Let's say she was not underage. Let's say they were all of legal drinking age. How does that change things exactly? How is underage drinking connected to the sexual assault? It's not. They are two separate things completely.

EPHE was likely correct. I admittedly didn't take into account that juvenile sentences are generally lighter- and it DOES say the judge can modify a sentence even for an adult.

Also, FTR, I agree with EPHE that this girl made some foolish choices. Partying without obvious adult supervision and underage drinking shows a lack of good decision making on her part. The difference between what the girl was doing and what the boys did is in the realm of she 'sinned against herself' (so to speak), whereas the boys sinned against/harmed someone else. When talking ethics- one clearly is worse than the other.
