That's how I see it. That's what I was alluding to. I don't know how the Law breaks it down, but those are the conditions I use to call it rape.

Sounds like underage drunken stupidity to me. I'd hardly call the boys "predators" .. so ridiculous. She accused them of something they were never even charged with that in effect altered their quality of life. I'd say that indeed deserve legal retribution against the young woman.

They were charged for taking a picture of her passed out on the floor, where they had physical contact and some body part was exposed. I've done some stupid crap drunk before, and I've seen people do some incredibly stupid things drunk before. That happens when you get so drunk you pass out. If they are to blame for their drunken stupidity .... so is she imo. Especially since nothing actually happened yet she went to the police anyways. Sorry, I call it like I see it and feel no pity for her.

What a bunch of BS. Some underage chick gets drunk at a party, passes out, a couple other drunk teens feel her up a bit and take a picture. That's hardly something to get your panties in a bunch for. If you don't want to get felt up by your peers, don't get drunk at parties and pass out. They didn't rape her.

That said, they should just own up to what they did and not let it destroy their lives. Sounds like a bunch of 'woe is me' emo s***.

Some posters in this thread seem to think the girl is also at fault. I'm sorry but I didn't realise we chose whether to pass out or not from alcohol, and telling people not to drink so much then is nonsense. I drank 4 cans of lager last week and spent the night throwing up, totally uncharacteristic for me; yesterday I drank 5 pints and now I'm up typing this before I go to work feeling fine.

She was passed out and gave them no permission to do what they did, being drunk is NO excuse. If this can be excused because the guys were drunk then so can any other drunk crime. They had enough of their wits about them to carry out the act and operate a phone to take pictures so they knew what they were doing.

They deserve to be outed and hey, she would have no crime to embellish if they hadn't committed a crime in the first place.

They admitted guilt and were charged with first degree sexual assault.

I must of missed this. Can you link where it shows evidence it was just "physical contact and some body part was exposed"? Did you see the footage also? Apparently I missed quite a bit.

The thing is, calling these kids rapists is just a little bit near sighted. They're hanging out at a party. This hot chick is drunkenly stumbling about, and eventually passes out. People are probably groping her all night and she's giggling like the dumb# she is. Then as soon as she's passed out and someone gropes her.....Oh Hell No!!! RAPE!!!! Yes, it is incredible isn't it, especially in light of the major dust up about "legitimate" rape. I guess we can count a number of ATSers who believe rape is not rape and fully support the idea that women "ask for it" if they drink, party, wear skirts and otherwise do not confine themselves to the church pew or the kitchen.

You know how girls are at parties? I remember underage drinking at parties. Some people got sick, some were fine. Some I had to pick up to put to bed, and choke down my own bile, as they puked on me.

Never at any party that I have been at, was there a disregard for humanity as was explained in the article.

Wow... That's quite a thing to say. So...if I get drunk and pass out at a party, I should expect to be abused and sexually assaulted? I'm a man of course, so maybe it's some other creative means of violating my person I should expect to have happen?

I miss entirely how the victim can be blamed for a sexual assault she wasn't even conscious to know was happening. First someone early on the thread gives that '2 to tango' nonsense ...and that ended when the fact she wasn't even conscious was highlighted...but now we're to expect such a thing to happen to us if we pass out at a party...among friends we THOUGHT we could trust?

What scares me ....really bothers me...is that sort of feeling suggests that you might not intervene to stop this sort of thing happening if you say it at a party you were at.

I don't know..maybe it's just me...but there'd be a physical fight and people..myself included perhaps....going out of that place bloody and hurting before I'd tolerate seeing anything like this happen in front of me. Absolutely no way should the 'peer pressure' have allowed this.

I think the group mentality that permitted it is actually as bad in the story as the actual crime. Her violation came on multiple levels......and they could only charge and prosecute the direct participants.

I just want to throw this out there, I know of girls that have gotten drunk at parties and slept with guys, all consensual. The next day the girl(s) realize that they had just banged "troll boy" and are ashamed so they cry rape. I'm not saying that this is what happened in this case but it should be considered, for sake of discussion.
