The problem is that in order to stand as a tax it have to be approved by vote in congress.
Congress so far has been adamant on approving new taxes as this will become another Federal tax like the one we pay now on Medicare and Medicaid aka entitlement programs.
While certain provisions of Obama care stands the mandate is not, at least until the wording is change and approved by congress.
Things are going to become very interesting.

I know, I got the entire understanding of what is going on with the Supreme court ruling on a government news radio news, they were very good expaining while it was not such a win as many are claiming for Obma care on the mandate people will not be very happy with a new tax.
I guess I will be voting for Romney this time around in election day.
Obama is not going to win the elections.

Exactly!!!!!!!!!!!!! I am not going to go into constitutional law debate now but you are correct and spot on, specially with elections coming up, so while some provisions of the obama care are ready to go, that littler part of the health care will be on the table in congress after elections.
