Explanation: Again as above so below ... [ hopefully 3rd time lucky ]

Thieves have custody of stolen goods ... that doesn'y make the goods not stolen or the legal possesions of the thief!

Claiming they have been to the moon and claiming they own the moon are two different things and I was posting about the claim of whether they have been to the moon [which is a bone of contention on ATS] and not posting about that they have claimed the moon.

If they did go there, then they did brings these luna rocks back and I am just focusing on the letter of the law legalities surrounding that.

Personal Disclosure: Your posted comment about the subsurface reminded me to go and recheck my position and reaffirm to myself that the UN laws did qualify the following ...

The Outer Space Treaty states that outer space, including the Moon and other celestial bodies is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means. The Treaty establishes the exploration and use of outer space as the "province of all mankind." The Moon Agreement expands on these provisions by stating that neither the surface nor the subsurface of the Moon, nor any part thereof, or natural resources in place, shall become property of any State, international intergovernmental or non-governmental organization, national organization or non-governmental entity or of any natural person.

And I was correct in my position BUT I can now see a flaw in the law as in one sentence it says even use is no excuse and yet directly after that comes ...

The Treaty establishes the exploration and use of outer space as the "province of all mankind."

But I can already see that that is EXPLICITY related to OUTER SPACE and not celestial bodies or any debrie that is floating around in that OUTER SPACE area! So we can take stuff from here and explore SPACE ..but we can't legally use anything that is out there except for the open space itself!

Your post also made me go look up a legal dictionary defination of 'property" which I grabbed from...

Property (legal) [freedictionary.com] .

property n. anything that is owned by a person or entity. Property is divided into two types: "real property" which is any interest in land, real estate, growing plants or the improvements on it, and "personal property" (sometimes called "personalty") which is everything else. "Common property" is ownership by more than one person of the same possession. "Community property" is a form of joint ownership between husband and wife recognized in several states. "Separate property" is property owned by one spouse only in a community property state, or a married woman's sole ownership in some states. "Public property," refers to ownership by a governmental body such as the federal, state, county or city governments or their agencies (e.g. school or redevelopment districts). The government, and, in particular, the courts are obligated to protect property rights and to help clarify ownership. (See: real property, personal property, personalty, common property, community property, separate property, public property)

And so I will check out the laws regarding COMMON property as thats what I would see the moon falling under if we actually owned it but since the laws say we don't own it and can't use it or any bit there of by any means ... well I won't post about that here as it would be offtopic!

.. it clearly covers EVERYBODY and therefor nobody owns it and I did state that in the OP ...

Oh, so then they couldn't have stolen it, because it didn't belong to anyone. So case closed.

Reality Check: Logic hits harder.... bro

Do you actually feel it's your moral obligation to prosecute NASA because they did something morally unacceptable or, more likely, are you just trying to "get back at them" for whatever weird made up reason it is that has caused this irrational bloodthirsty disdain for NASA? The premise of this topic is painstakingly obvious: you don't like NASA, ergo NASA must be punished.

The information from examining those moonrocks benefits the entire mankind, but you want to put an end to it because... well, because you just want to. How noble.

Explanation: Cool! If the UN laws aren't applicable I am completly fine with that! [I have been reading the pdf's and they are completely contradictory and not worth enforcing even if ratified! ]

Personal Disclosure: Well if Nasa found a loophole in corrupt laws ... then good on them! But BOO to the UN!

Seems my claim has been successfully FOOMED by my fellow members!

Mod's please close this thread! [I have alerted also!]
