If you go to some remote island in the ocean, and mount an expensive expedition to get there, and then collect a few souvenir rocks and dirt to take home with you....those trinkets are yours. You made the effort, you spent the money.
You did NOT lay claim to the island, you explored it for the first time. You don't "own" the island....let's call it "community property"....
There are international treaties in effect that essentially are designating all celestial bodies - planets, moons, asteroids, comets, etc - to be no one's "property" and exempt from claims of "possession" by anyone.
One day, this will become a problem....maybe even this century, in a few decades. If and when there are ever permanent bases, and especially mining activities, with the potential for profits from any of the raw materials obtained.
It occurs to me to mention the continent of Antarctica. It is claimed by no nation, and is not itself a legal entity, as far as I understand it.
Might want to compare the laws regarding bases there, and exploitation of its resources, to what the future holds in space.

Keep in mind that some Lunar material here on Earth was obtained form meteorites. Those have different provenance from the actual Apollo samples.
Any of the official "gifts" that were dispersed to other nations in 1969 and 1972 were encased in Lucite, which made it virtually impossible to ever set them "free". (Ask anyone who is retired Law Enforcement....when they retire, they can have their old badge as a memento, but it must be inside a block of clear plastic - - Lucite).
There are reports of some Lunar material in NASA's possession that has been "snuck out" of the containment facilities, over the last several decades.
THAT is what they are interested in, stopping the black market that can arise in the trading of those samples.

The Moon, a satellite (real or fake) floating around in outer space is owned by NASA/government?
Do the Chinese and Russians have to buy a ticket from NASA when they explore the Moon?
