Okay, I think I got this all figured out now.

HR. 1540 adds to and takes away from the National Defense Authorization Act signed into law by George Bush back in 2008. What some are posting is the complete ACT (mark up) with the included BILL additions and subtractions.

What got submitted as HR 1540 is just the changes to the CURRENT act. Probably to reduce the use of paper. This HR does not include a section 1034 because no changes are being made to it. THEREFORE, section 1034 is most likely already law. Problem I have is trying to figure out when section 1034 came into existence in its current form. But there is no NEW section 1034 being submitted to congress. This section is already law some kind of way.

What got submitted to Congress in the form of HR 1540 does not include section 1034. Therefore, its probably already law. Matter of fact, its Public Law 107-40 as stated in the 1540 Mark Up as constitutional authority.

(a) IN GENERAL- That the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.

So these powers are a decade old thanks to Bush. But I still maintain what got submitted to congress is different than what some are posting. So they must have taken it out because Public Law 107-40 already gives him that authority.

How does that Congress vote declare WW3?

This was all part of the Patriot Act, signed into law in 2001.
