If you look at the clause, “[n]o person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President,” you can see that the second comma is making “at the time of the adoption of this Constitution” applicable to both “natural born citizen” and “citizen of the United States.”

Yeah, but thats clearly not their intent. No one could make a reasonable argument that the framers were aiming for a single generation nation.

We just have to be a little more lenient with comma usage as an adjustment for a time when spelling and grammar was a little less standardized.

Nor was I suggesting it, rest assured.

I was simply expressing my criticism of the clause, and the deficient grammatical construction is just one aspect of the clause worthy of that criticism. In my opinion, obviously.

That makes absolutely no sense. You're saying that some other country's citizenship laws have any bearing whatsoever on US citizenship. What if Greece passed a law saying everyone born in Michigan was a Greek citizen at birth. Does this mean that everyone born in Michigan can't be a US Citizen because the US doesn't recognize dual citizenship? The birthright citizenship clause of the Constitution was specifically added to repatriot slaves that many believed were not "real" Americans. Everyone born on US soil except for children of ambassadors or children of an invading army are citizens. Their parents nationality is irrelevant. The United States treat every child born on US soil as innocent and American.

All your favorite founding fathers could not have been born on US soil because they were born before the United States existed. You would never challenge their status as American citizens because they were white guys.

Dude, the guy doesn't sit on the Supreme Court? He merely added his opinion. He was using a nonbinding resolution to make his case in conjunction with the first Congress.

The guy in the video doesn't sit on the bench.

Look, let's make it simple.

Obama went through the same election process that every other President in the last 50 or more years has done. His fellow opponents recognized him as eligible to run for President, the voters voted him in so they had no problem with his eligibility, the electoral college recognized him as eligible, state politicians who certified results accepted he was eligible, and Congress, who sealed the deal, accepted him. A Supreme Court judge swore him in.

Look at all these powerful people call him Mr. President.

Let me make my case simple too. Tradition means nothing. I don't care how many presidents went through the same process or broke the law without consequences. If Obama is disobeying the constitution then he is a criminal and belongs in prison. I don't appreciate the idea that if something was done wrong 35+ times it should be done wrong a 36th+ time that your simplified summary means.

The case was not presented as an opinion in the video, and was not an opinion. The video makes the case that "natural born" was clearly used in the era of the constitution to mean two parents that are both citizens. The author researched the meaning of the word (something you have not done) and concluded the word was used to mean born to two parents of the same citizenship. You can counter that word usage FACT with other facts of your own, but until then I'll believe the only factual evidence I've seen: the facts presented in the video.

The video kind of kills itself at the end. The entire case it is making is that a NON-Binding resolution MUST be followed and then ends with "Are we just going to flush the constitution down the toilet?" What kind of farce is that? The constitution says no such thing, this non-binding resolution does. You would think strict adherance to the constitution would do away with non-binding resolutions altogether as they are just a backdoor way to agree to pretend to agree about something they could never legitimately pass into law. The video fails if you just pay attention to it.

Andrew Jackson (1829-1837) is the only president born of two immigrants, both Irish.
Presidents with one immigrant parent are Thomas Jefferson (1801-1809),
whose mother was born in England, James Buchanan (1857-1861)
and Chester Arthur (1881-1885),
both of whom had Irish fathers, and Woodrow Wilson (1913-1921)
and Herbert Hoover (1929-1933),
whose mothers were born respectively in England and Canada.

Wilson and Hoover were grandfathered in but not Obama?
You are going to have to educate me on where you learned this. I am getting a little sick of youtube videos of people expressing their opinion. Please explain to me the grandfathering in of Hoover that excludes Obama.

I think the Army needs to ignore this ignorant nonsense and carry on with all the issues they are already stuck dealing with.

Let's give it ten minutes and check back here to see which one of our posts had magical powers and wich one just sounded like an empty wish.

Really? So, by your definition, all of the anchor babies running around will someday be eligible to be president? All you have to do is sneak into America, which is real easy to do these days, pop out a kid, and BAM!! it's a natural born citizen and can someday be president. Wow. I did not know that. Thanks for enlightening me.

Yep, thats pretty much it. And now you do know.

What a crock the video in the OP is.

The resolution was about McCain, to determine whether being born in the Panama Canal zone constituted US soil. The fact that both his parents were US citizens serving in the military is used to enhance the claim that he has a right to be called a natural born citizen.

Obama was, purportedly, born in Hawaii to an american mother. That automatically qualifies him anyway.

Obama sponsoring the motion doesn't mean he's proved himself to be ineligible. It simply proves that McCain was, because of the soil technicality.

This is not true. The criminal code, passed by Congress and states defines criminal offenses---except for treason, which is explicitly and intentionally restricted by the US Constitution.

I don't appreciate the idea that if something was done wrong 35+ times it should be done wrong a 36th+ time that your simplified summary means.

I think that simplified summary is supporting evidence that nothing was done wrong, in fact.

The case was not presented as an opinion in the video, and was not an opinion. The video makes the case that "natural born" was clearly used in the era of the constitution to mean two parents that are both citizens.

There are multiple ways that a person can be born a U.S. Citizen, and Congress can decide upon all of them, except that those born in the United States are always citizens (with the usual 14th Amendment caveat).

Being born abroad in some circumstances, to two U.S. Citizens is an additional way the child can be born as a US Citizen.

If Congress passes a law that a baby born on the far side of the Moon is a US citizen from birth, then that person is at 35 years old eligible to be President.

The author researched the meaning of the word (something you have not done) and concluded the word was used to mean born to two parents of the same citizenship.

Not exclusively.

The U.S. Supreme Court has jurisdiction over the precise meaning of the US Constitution (as the Constitution says).

The 14th Amendment was passed after the era of 1789, as well. After the 14th Amendment, it is settled law that anybody born inside the US is a US citizen from birth, i.e. "natural born" --- that he does not need to be "naturalized" to become a citizen.

And in any case, there is also a matter of legal standing, and I believe courts have ruled on this as well. If the candidate is ineligible to be President, who has standing to stop him legally?

Congress does---upon the accepting of the qualifications of the electors. That's it. If there later becomes evidence that Congress was materially deceived when so voting, then hypothetically Congress could sue or impeach.

Now in an impeachment or court proceeding, what would the committee or court need to see? Actual evidence that Obama was not a natural born citizen---for example, clear evidence of a birth outside the USA stronger than the evidence that he is. There is no such legitimate evidence.

Come on, I don't even support President Obama, but this is a stretch. In the case of McCain, item 2 (U.S. parents) was only used to collaborate item 1 (U.S. Soil). With our nations strong history of support for immigration I can't imagine that the framers or any Congress since that time intended to require both parents to be citizens to qualify as natural born.

This issue should be dropped so this man can be challenged soley on his incompetence. Nothing else is needed.

They don't work for me. The only thing that is relevant regarding this topic is what people meant in the late 1700's when they said the words "natural born". The fact that Andrew Jackson, Woodrow Wilson, etc may or may not have been constitutional criminals is not relevant because it doesn't tell me how most people used that phrase in the late 1700's.

Here is the one and only data I have on what it meant in 1776 to be a natural born citizen: Source: www.lonang.com...
Emmerich de Vattel 1758

"The natives, or natural-born citizens, are those born in the country, of parents who are citizens."

I more than welcome others to add their own historical quotes from the era so that the answer can be more solidified as to what "natual born" actually means in the context of the US constitution.
