Dude, the guy doesn't sit on the Supreme Court? He merely added his opinion. He was using a nonbinding resolution to make his case in conjunction with the first Congress.

Look, let's make it simple.
Obama went through the same election process that every other President in the last 50 or more years has done. His fellow opponents recognized him as eligible to run for President, the voters voted him in so they had no problem with his eligibility, the electoral college recognized him as eligible, state politicians who certified results accepted he was eligible, and Congress, who sealed the deal, accepted him. A Supreme Court judge swore him in.
Look at all these powerful people call him Mr. President.
