I think I need to correct your mistakes so that others don't get wrong ideas. YES indeed SIR, telling someone you are going to slap the cr*p out of them is most certainly illegal... it's called ASSAULT.
Look it up man, because I know you won't believe me. Assault is when you THREATEN to hurt someone or in any way make them feel afraid or threatened. For example, even if a man stands over a frightened woman (or man) and makes them feel threatened, they can and will be arrested for ASSAULT.
BATTERY is when you actually strike them or make contact with them in a threatening or hurtful manner.
Those are TWO separate charges... ASSAULT and BATTERY.
So, while you may have noticed some good things in the video, you are grossly mistaken about what's going on there from a legal perspective.
Plus, there is a separate crime called INCITING TO VIOLENCE, and that is any kind of taunting that encourages someone to do violence, either directly or indirectly. For example, if I get in your face and call you names or say things that are designed to inflame your anger, such as insulting your mother, or calling your wife a foul name, and those words cause you to ASSAULT me or commit BATTERY against me, then we have both committed crimes... plain and simple.
legal-dictionary.thefreedictionary.com...
The act required for an assault must be overt. Although words alone are insufficient, they might create an assault when coupled with some action that indicates the ability to carry out the threat
SPacifists follow principles of nonviolence, believing that nonviolent action is morally superior and/or pragmatically most effective. Some pacifists, however, support physical violence for emergency defense of self or others.
White man: Why you being so hostile, man?
Black man: ‘Cause. I’m pissed off.
White man: Well its better to be pissed off than pissed on.
Black man: Take your ass up there right now
White man: [standing to go to the front] You ain’t scarin’ this white boy. I’m 67 years old. You ain’t scarin’ me. You ain’t scarin’ me.
Black man: [now, also standing] I’m 50.
White man: You ain’t scared of me. You ain’t scarin’ me.
Black man: I’ll put my foot up your ass.

We don't know what was said BEFORE the shoe-shine comment. These guys may have been riding the bus together for years, and who knows what the black guy had done or said to the white guy earlier, to even instigate such a comment. Interesting the video starts running at such a convenient time.
My sentiments exactly, zipping into the mannerisms in the instant the video was initiated, maybe even cropped at that point.

I loved the fight, and I loved the way the young dude went forward willingly, virtually volunteering to get his ass beat.
I was a bit annoyed by the crap the old guy was saying, implying that the kid should shine his shoes. I hope he wasn't implying that it was because the kid was black. I hope his comments were initiated by something the kid said first, otherwise, I'd have to put the blame in the older guy.
