hmmm...there's a minor contradiction in the logic of your post. We the people didn't authorize those cops to do a background check on Obama, the cops took it upon themselves to tap information that is forbidden to them unless there is just cause. Now, lets reverse the setting here. Suppose the cops decided to do an unwarranted background check on you. Is that the government working for the people, or vice-versa? Try and remember that the cops still work for the state, who work for the government, who also work for the people. I doubt that if a warrantless search was done against you that you would consider it in the best interest of the "people" at large. I'm pretty sure that you would consider it a violation of your personal rights and a threat to the rights of others.

I would keep the fact that your brother has broken local and federal laws by abusing police authority under your hat. I'm sure that he would really hate to lose his job because his brother outed him on ATS. Background checks can only be done with probable cause, approval of a judge in cases that may require arrest, or traffic stops in order to obtain driver information. There are a few other bits and pieces to that story, but, you get the point. If your brother is running background checks on any random person without their permission or without having probable cause, he can be terminated at any time. Its called "abuse of authority." And just because HE does it, does not mean that it is within his authority to do so. Its downright illegal, period.

There is a reason why laws are set up to protect the privacy of an individual, and your brother is shredding those laws as he sees fit.

Like I said, that is not something that you should be openly bragging about.

This is like beating a dead horse, but,...NO, they cannot run background checks on whoever they want, whenever they want. In this case, they were dumb enough to do it to the president, so now, they're fired. I think that the result pretty much collaborates my statement. Secondly, in order for police officers to be able to access background information on the public, cops are required to have probable cause, an approval from a judge, or they can obtain said information from traffic stops etc.

Now, its common knowledge that the police repeatedly break these rules, but, that does not mean that they are legally allowed to. Don't mix things up in your head because threads like these completely contradict the first statement that you made.

In the end though, I see the point that you are trying to make. We are all on the same side here, so, as far as I'm concerned, things have gotten way out of hand with the amounts of powers that police constantly seem to abuse.

Could you please cite the federal laws they broke? I'm interested if you know which ones they are. Off the top of my head I can't think of one. But you must know, so please share.


Oh, I can quote one law protected federally and is listed by the constitution.

How about, "The right to privacy"...but, that's just off the top of my head.

Question... how is it cops can perpetrate any crime: lie, cheat, steal, kill, injure, You name it- and they get a little paid leave and an administrative note in their records... but search out the president's criminal record, and it's jail time and all sorts of crap.

Quite stupid.

It say employment at the top of your list and there is serious debate over this. So these guys were running a check to see if anything came up.

Housing--Moving into the WH--->background check

I got one for my job. BO should to, now were these the people to do it? I doubt it

Your brother is breaking the law doing background checks on guys your sister has dated. He just hasn't been caught or his department doesn't care that this is happening. It is an invasion of privacy and your brother has no right to do that. You cannot run a background check without probable cause or the person has been arrested. Protecting your sister from a guy that may or may not be a jerk isn't probable cause.

Its against policy and probably against the law in so much as an invasion of privacy to run peoples backgrounds without reason. You must be running an individuals background while in the performance of your duties.

If you brother was discovered doing that by his superior officer he would be reprimanded and possibly fired for it. You cannot use the NCIC as your personal fun toy.

Seriously folks? The amount of responses here against the officers is amazing...they were probably bored, eating their donuts, sippin coffee, and thought well what heck, lets type in dur fuhrers name and see what happens. I'm sure they type in random names all the time, celebrities and such.
If any of that info becomes public then they should be fired, if they just looked at it and laughed, then no big deal IMO.

BTW...did they type in Barack Obama or Barry Soetoro?

it was very wrong and yes corrective action needed to be taken. i work in a line of business where we have special data bases that we can access all kinds of info about whoever we need to, we are told in the beginning of our job if we are caught looking up anyone that we aren't supposed to its grounds for immediate termination....and they do watch, years ago someone got in trouble for looking up Derick Jeter lol. lol.

any professional that access to tools like that should only be using them as intended.

Federal and contract employees working for IRS have been fired for looking at tax returns that they were not working on. I expect that many police check on people who are not suspects and never suffer the consequences. Anyone dumb enough to run a background check on the President is too street stupid to be a police officer.

They should be fired, it was an abuse of their position. They should be fired for sheer stupidity - did they think they could run a background check on a sitting US president and NOT attract the attention of the US Secret Service? These guys are just plain dumb.

Now remember the uproar by republicans when a state employee ran a background check on "Joe the Plumber"?

State employee says she was ordered to check out Joe the Plumber

No one should have the ability to access a sitting president's records, for reasons of national security. Can you imagine pulling up a president's credit record and finding out the guy has a customer loyalty card from Hooters in Georgetown? What a great place to plant a bomb. Yea that's a stretch but they need to keep personal info personal. Not just for the president but for all citizens.

Well, cops know for future reference not to dare look up a political figure, least of all Obama.

It is too bad, though. If Kennedy had this much protection, security staff able to leap tall buildings to protect even his good, er um, name, the world would be a much different place today.

Does your sister ask your brother to run the checks? Your brother obviously likes to abuse his power and thinks he knows what is best for others like most pigs. Why doesn't he ask his sisters boyfriends about there past straight to there faces? I'm sure he feels powerful behind that badge of his.

That's very interesting you say that, I'm sure a court Judge would be a very professional person. But I just saw on the tube, a Judge was caught using one of those things guys use on their private parts with the suction pumps, but this was during Murder trials, more than once, he must of been bored old pervert.
They could hear the pump going , but it took awhile to actually catch him with his pants down.

If McCain had been elected a lot of us would have had to swallow that outcome, salute the flag, respect the principles of democracy and get on with the program of being Americans. We did it with Bush because the concept of America is bigger than one election.
