Having been stopped and arrested at an illegal joint task force roadblock conducted by tribal police, U.S. Customs, and the Border Patrol several years earlier - merely for asking a few questions, I always made sure to carry a camera with me when traveling along this road.

After the 2002 arrest, I fought the charges in court where they were dismissed 'with prejudice'. I then sued the tribal police for malicious prosecution and civil rights violations in federal court. That case is currently in the 9th Circuit Court of Appeals.

I support the attempt to educate people on their rights; more so then ever when it involves the police. People tend to forget their rights when authority comes around and the police know this.

Hell, they are legally allowed to lie to you about the situation, information and your rights.

However, and here is where some shaky ground comes in, are you aware of the Border Search exception?

I find particularily interesting the lines referencing specifically, ethnic profiling. Is it right? Not entirely in my opinion. Is it the law, and with arguable cause? It would appear so.

I am not trying to say that what is happening is ok.

I do feel, however, that if it ever came down to it (whatever the hell that is supposed to mean), that this 'exception' would be used to defend their actions.

This would appear to be your situation.

In regards to the kids failing bad:

I think the video shows the downside to 'kind of' knowing your rights. True, the stop is on shaky grounds --in my opinion the exception should apply only to the border, and not 'proximity to the border'.

However, if you are going to assert your rights, you better know damn well what they are.

...even if the exception is being abused.

To bad they taught me my constitutional rights when I was in the fifth grade and not when I was a bit older and better equipped to learn them and remember them and understand the extreme significance of them.

I'm sure that's pretty much the standard across the country.

To answer your question: Yes, it is suspicious.

I understand that your rights are never actually taught to you (to the extent that you can actually assert them if needed). This is wrong.

However, this does not mean that people can not know their rights. All it takes is some reading (not even anymore), and you can know what the hell your rights are.

Not being taught/told your rights by the education system/police is one thing...but to know this is the case and to not do anything about it is another.

So let me rephrase.

I think you misunderstood what I was getting at.

My point is that in one of the videos you post, the person in the video (you or someone else, doesn't matter) is clearly telling people to know and assert their rights while not addressing the issue of the exception.

Why show something that, when taken at face value and applied in their life, could seriously screw them over?

It's wrong but its a law (even if its being stretched too far in my opinion).

Nor do I know anyone involved in the making of any of the videos in this thread.

Second: Im not sure, im showing information that can "seriously screw" a persons life. Though its not my responcibility what a person does with this information, so i dont feal so bad.. The Videos were mearly redirected from youtube to this site, by this site's embeding technology. If there is some sort of legal concerns about "trying this at home.." Then it would not concern me. It would be the fault of the original creator of the Vids, perhaps.. and the website inwhich hosts them; youtube.com being one of them..

And I still dont get what your talking about, no..

in laymen's terms he is telling you to add your two cents to the matter being posted and not slapping some more video up for others to dissect in their own manner.
He and myself would like to see some discussion behind your videos we can all watch videos and think and manipulate whatever means we want within our own reality or mind, but it's more interesting when you discuss the subject after showing the videos.
After watching teh videos I seen some bent out of shape us citezens exercising their rights in a rude offensive manner, yeah sure it sucks to be checked by check stops and so forth especially when your drunk j/k..

But here in the videos I see border patrol doing their job "oh my god its so wrong"!! all the goofs had to say in the vehicles instead of being smart ass's is "yes I am a US citizen", wow how hard is that "its so against my rights!" would you rather have every city in the USA closets to the boarder like Miami for example all infested with Spanish speaking immigrants running rampant everywhere? or would you like them stopped before entering?

Me personally I would rather have them stopped and the reason these check stops are beyond the US border is because immigrants run across the border and catch rides steal cars and the list goes on.... so being the smart organized police type the border patrol are they increase check stops and it helps so please tell me what you find wrong with these videos.

Dood, Seriously, for your own protection, next time you are at a check point at night and raise a camera (can be mistaken for a weapon) to an agent you had better have a witness and a flak vest because dood, you're gonna get shot.

You honestly don't make much sense there COPYPASTA, so because you watched a bunch of youtube videos and have a bad attitude and now we should all take action? Just because you assume are futures are gonna be bad because some dude recorded his bad attitude at some border control check stops.
Not all of us have bad attitudes and make problems with border patrol guards.


Everyone has different views on the subjects you protest but that doesn't mean there is anything you can do about it, now is there?
