I think as may be you aught to re write your post. The man doing the damage is a 58 year old man, the 37 year old ex soldier was the man trying to calm him down and stop him trashing the memorial.

It most certainly is, however!!!!!!! Does what he did constitute breaking the law? Does it cross the threshold to Hate crime?? Who is the victim, where was the property located, and who's property is it actually are the kinds of questions that will be asked in the courtroom, assuming Brits still have any rights left. Was any of it actually destroyed, or merely relocated off the main public right of way and just kind of made a mess of in general?? Remember in the USA we had the Westboro Baptist church who would frequently show up at funerals of American soldiers killed overseas and spout the most vitriolic slander about those being grieved on site. They did not get charged with hate crimes because they are very careful about public right of way vs private property and their right to speech.

Assuming, again that Brits have a right to protest anything, which they no longer do as everything becomes a hate crime, a normal litigation process would likely knock this down to a public nuisance and littering charges. Hate crimes should not even exist, they are only an aggravating charge to an existing charge that already broke the law. Or if you are in Europe, Hate crime charges are a great way to stifle any and all public dissent about anything since the power of the Monarch is absolute criticisms of the government and its policies are also now arbitrarily charge as hate crimes on a whim.
