Biden prepares an order that would shut down asylum if a daily average of 2,500 migrants arrive
WASHINGTON (AP) â The White House is telling lawmakers that President Joe Biden is preparing to sign off on an executive order that would shut down asylum requests at the U.S.-Mexico border once the average number of daily encounters hits 2,500 between ports of entry, with the border reopening only once that number declines to 1,500, according to several people familiar with the discussions.
The impact of the 2,500 figure means that the executive order could go into immediate effect because daily figures are higher than that now.
The Democratic president is expected to unveil the actions â his most aggressive unilateral move yet to control the numbers at the border â at the White House on Tuesday at an event to which border mayors have been invited.

Ironic part is he used the same strategy with his executive order as Trumps âMuslim banâ. Trumps got shot down in the courts because of how US asylum law is.
So my guess is Biden and the left used this strategy to look like they were doing something knowing it will get shot down. Then theyâll blame the people who appointed those judges, which may be the right.
They had years to address this and did nothing. Now theyâre pulling a stunt and are going to cry foul when it âdoesnât work outâ.
The six months leading into elections are always the worst political theater. Saying something since that bar is already so low I tripped over it.
Statute
Section 212(f) of the INA reads as follows:
f. Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.
