The vote was 216-207, with one Republican, Rep. David Joyce of Ohio, joining all Democrats in voting no. Seven Democrats and one Republican did not vote.
At issue was Garland's failure to hand over audio of special counsel Robert Hur's interview with President Joe Biden about his handling of classified documents. Republicans had demanded the audio after Hur declined to prosecute Biden, in part, because a jury might sympathize with him as an "elderly man with a poor memory."

Former US Attorney General Michael Mukasey has knocked current AG Merrick Garland for making a “flawed privilege assertion” to withhold audio recordings from Congress of President Biden’s interview with special counsel Robert Hur.
Mukasey, who served as the country’s chief law enforcement official under President George W. Bush from 2007 to 2009, said in a declaration filed in federal court in Washington, DC, on Friday that Garland is wrong to hold back the recordings.
The ex-AG noted that Biden’s attorney general had mistakenly relied on a 2008 letter authored by himself to assert executive privilege during special counsel Patrick Fitzgerald’s investigation into the unmasking of CIA spy Valerie Plame.

The House Judiciary Committee intends to file a lawsuit, according to Speaker Mike Johnson, in order to forcibly prompt Attorney General Merrick Garland to produce the audio recordings of President Joe Biden’s meeting with special counsel Robert Hur.
The Justice Department informed Congress that it would not be filing criminal charges against Garland in spite of a House resolution holding him in contempt, so this lawsuit would be the most recent attempt to obtain the sought-after tapes.
“We are going to file suit next week against the Department of Justice to enforce that subpoena. We will go to district court here in D.C., which is the appropriate venue, and we will fight vigorously to get it,” Johnson (R-La.) told reporters on Wednesday.
Republicans contend that hearing the tapes will offer further context for the special counsel’s remarks regarding the president’s senility and memory, even though lawmakers already have a transcript of Biden’s chat with Hur.
