Read section 3 of the 14th amendment. It states in part:

"No person shall .... hold any office, civil or military, under the United States ..... who, having previously taken an oath, as .... an officer of the United States ... to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."

The insurrection was against the Constitution. It attempted to defeat the process specified in the Constitution for the peaceful transfer of power from one elected POTUS to the next one.

I've noticed that for some reason Donald Trump and his worshippers don't seem to be intellectually capable of distinguishing between 1) the office of POTUS, which is a position of authority and responsibility established under the Constitution and 2) the individual person who happens to be occupying the office at the time. The difference is the difference between a monarchy and a democratic Republic.

Understanding this requires holding a thought in mind that has 2 moving parts. Kind of like walking and chewing gum at the same time.

I think that Donald Trump himself has pretty much confessed to having engaged in a plot to stop Congress from certifying Joe Biden. Trump's defense is not that he didn't "do it", but that he, as POTUS, had absolute immunity.

Now, whether or not the states have standing to make this determination is a very valid question. I guess we'll find out when SCOTUS finally addresses the issue.



If I say that YOU have engaged in insurrection, what defence can you offer?

A conviction is not cited as a requirement that is in the 14th Amendment, Section 3, as a disqualification for office.


Here you go again.

It's not in The 14th because it's in The Constitution. Due process and etc.
