Federal judge says Trump does not have absolute immunity, denying bid to dismiss election case

In a double blow for the former president, this Friday serves up another legal loss. Donald Trump's Hail Mary to get the federal election tampering case dismissed went belly up this evening, the same day another court found that the Jan 6 civil lawsuits against him could move forward.

The federal judge presiding over former President Donald Trump’s 2020 election subversion case in Washington, DC, has refused to dismiss the charges against him, saying he does not enjoy absolute immunity for what he said and did after the election.

“The court cannot conclude that our Constitution cloaks former Presidents with absolute immunity for any federal crimes they committed while in office,” US District Judge Tanya Chutkan wrote.

“Whatever immunities a sitting President may enjoy, the United States has only one Chief Executive at a time, and that position does not confer a lifelong “get-out-of-jail-free” pass. Former Presidents enjoy no special conditions on their federal criminal liability. Defendant may be subject to federal investigation, indictment, prosecution, conviction, and punishment for any criminal acts undertaken while in office,” Chutkan wrote.

Different cases, different courts, similar rulings. There is NO immunity. There is no immunity for what we do, or what we say, regardless of our position of power, or social status, or wealth. Everyone is the same in the eyes of the law, and no one is above the law. A president is not above the law, and neither is a former president.

That we are even discussing this shows just how far the American moral center has shifted. It should be common sense to any American that nobody is above the law. We used to chant it proudly. Now some spit on it.

I feel confident we're going to find our way back to our moral center. Slowly, but surely.

Trump did this all to himself man. And he is dragging people down with him. At some point you have to realize he does not care about you only for himself. And that makes him a danger to our republic.

Y’all seem to think it’s ok for “your guy” to get away with crimes. Joe didn’t hold office during Trumps term.

I guess that means the cowardly legislators who turned tail and ran when they thought "the country was under attack" can be charged with desertion.

And the racist pig Michael Byrd can be charged with murder and sued for the wrongful death of Ashli Babbitt. If the coward isn't still hiding out at an Air Force base somewhere.

Yeah, this is the one where they want to charge him at a Federal and a State Level for the same thing and hope to get a conviction.

She has a not good history and deserved what happened.

There’s been A Lot of pressure to take down a former prez like I’ve never seen. Given I wasn’t alive for JFK.

But my god.

To hold American civilians in the same capacity as terrorists, just only one person exemplifies the audacity to which our government will throw down to prove that 1984/Brave New World is exactly how it’d turn out.

We never went to SA. We spent decades in Iraq and Afghanistan. Only to have to lens focused on people concerned on American voting. And how they did it.
