A Michigan judge ruled Tuesday that former President Donald Trump will remain on the state’s primary ballot, dealing a blow to the effort to stop Trump’s candidacy with a Civil War-era Constitutional clause.

It marks the second time in a week that a state court declined to remove Trump from a primary ballot under the insurrection provision of the 14th Amendment.

In Michigan, Court of Claims Judge James Redford rejected arguments that Trump’s role in the Jan. 6, 2021, attack on the U.S. Capitol meant the court had to declare him ineligible for the presidency. Redford wrote that, because Trump followed state law in qualifying for the primary ballot, he cannot remove the former president.

Additionally, he said it should be up to Congress to decide whether Trump is disqualified under the section of the U.S. Constitution that bars from office a person who “engaged in insurrection.”

This is on the heels of another Michigan case that was tossed, here we have a judge making a decision.

That decision will be appealed as per the article. Tomorrow Colorado will have their closing statements on the same issue with a decision scheduled for Friday.

ETA
Summary judgement from yesterday.

I’m not pro or anti Trump. But I am pro legal system. Let the people pretend to vote.

Don’t get me wrong I have 18% faith in the legal system at most. But it seems laws are made and selectively enforced.

I guess we should enjoy the little victories when and where we can, but unless something drastic happens to slow it down or avert it altogether, we are headed for a Peoples Republic of America.

Removing a front running candidate from the ballot of even one state throws the whole primary and/or election. It's time for congress to step up and do their job, but fat chance of that happening when you have republicans voting with democrats to protect Marxist Mayorakas from impeachment.

The uniparty isn't going to allow the administrate state to be dismantled. They will fight for it, and the same goes for keeping Trump out of the WH. BAMN!

That's surely one good argument. Election interference in just about every possible facet and not a single prosecutor is stepping up and courts are side stepping as well.

I'm rather coming from the position that denial of civil rights sans any due process is the inherent problem with the 14th amendment argument.

Understood, but this and everything else that's happening to Trump is for our benefit. It's a show of power, and a preview of what's to come for the rest of us.

That I absolutely agree with.

If they can do this to an American like Trump, imagine what they can do to us nobodies. (What they are actually doing to nobodies....)

There was no "subversion" or "insurrection" on January 6th, 2021. Everyone knows it was U.S. taxpayers protesting Joe Biden's AMAZING (Unbelievable) victory, inside the building they pay taxes to maintain. i.e. OUR Capitol building.

In state after state, even courts with Democrat-biased judges understand this TRUTH.

The Jack Smith trial of Donald Trump inciting an insurrection is DEAD....DONE....NON-STARTED.

With Heir Whitmer firmly in control along with the Socialist Democrats, I gave up on our fair state of Michigan.

I don't want to give up, I live here in Western Lower Michigan which is still mostly conservative in my rural area, but that is changing. You have a Democrat-controlled Detroit region with a high population of African Americans and Muslims. Lansing, not sure about the state capitol, but if Whitmer is there, it's corrupt like the big swamp in DC. Grand Rapids, I suspect is fairly liberal as much as they like to compare it with Detroit. Then there is Chicago, not in Michigan, but almost as close to me as Detroit, and they do come up here to vacation.

At least the hadjees in Dearborn and Hamtramck are against the homo-transexual agenda in the schools. However, I suspect they just love the Quran along with Hamas and Gaza, so I can't support them based on that alone.

I don't want to let go of the Great Lakes State, but she is going down without a life jacket. I'd move to the U.P. esp. if they wanted to become their own state separate from the lower. They used to want to be their own state back in the 70s, I wonder if they still want that now.

Something like this coming out of the Michigan court system?

I'm truly and utterly shocked. Honestly.

We'd know for sure.
