"For Trump to have his fate in the hands of this judge, whom he has vilified, is malpractice by his lawyers and very ominous for him," Litman wrote on X, formerly Twitter. "It's incredibly easy to ask for a jury trial. You just check a box on a form. Hard to believe that Trump understood that his lawyers hadn't done it when he's been savaging the judge who is now the factfinder in his huge fraud trial," he added. "I honestly can't believe that any lawyer hired on such an important case could make this mistake," wrote defense attorney Andrew Fleischman. "But I also can't think of any strategic reason you'd want a bench trial in front of a judge who just sanctioned your lawyers for making frivolous arguments."


Could this be as simple a screw up as Salon makes it out to be? Or could this be one more example of Trump's superior intellect in finding ways to skirt the legal system.

Is this his ploy to have malpractice to stop this trial till he can get a new lawyer to replace this inept one or is it one more case of, you know, Trump knowing the best people to get done what he wants to get done.

The reasoning I have seen is that it is easier to appeal something on the grounds of a biased judge that a whole group of jurors, but I am no lawyer, just repeating some of the chatter as to why.

The other possible reason I have heard is that the likelihood of getting a "fair" jury in that pool is slim. Who's to say why but him though.

Either way, I would not want to be Trumps lawyer right now, or a previous one for that matter. You know, they have a habit of being jailed, disbarred or unpaid bills.

Since this is a civil trial, are juries an option? If the option was available and this was an oversight, that seems like a big mistake to me.

I guess that makes sense. I wonder if all of his vilification and name calling is part of his plan to get an appeal so as to get the judge to react in a way that would give evidence of emotional bias against Trump. Maybe Trump has been attempting to antagonize the judge.

Where has that superior intellect and beating the court been the past few years? It’s seems like recently every case has gone pretty bad for the guy. I think it’s been proven that the whole trump is playing 4d chess is major cope from his supporters at this point. Trump has a habit of shooting himself in the foot during legal proceedings and for a much older example of that go watch the death of the USFL documentary.

One jury I was on was a civil trial.

I wonder why ANY lawyer would take him on as a client at this point with the record he has of running through them so quickly.

Why would you want your fate in the hands of the public who is currently brainwashed to hate the man. Literally brainwashed. Not just lefty bois either. A lot of people need to really educate themselves.

Exactly this IMO.

Put to rest the jury and the likely makeup of it and put it all on the judges and prosecutions shoulders for appeal.


It's a hell of a gambit yet just might be his only play in this farce of "justice."

In New York City, anyone named Trump is found guilty by a jury. Same with D.C.. Why subject citizens to months of boring testimony, when the end result is known anyway.

First of all,

1. He's a lawyer.

2. The BAR is a club that requires accepted membership and an unspoken fidelity amongst members.

3. Is it really that hard to make a phone call with a deal that may end your law career but you'll be compensated handsomely for your sabotage?

4. Lawlessness is unbridled and unchecked. You can't expect justice, especially the justice that you know is right but conflicts with the "new normal" which is lawlessness.

Trump didn't stand a chance at all and they were just waiting for him to become a civilian again and they used the collective power of the deep state to skewer him.

Biden can waltz through the tulips while Trump gets raked over the coals. The WHOLE system is like an antibody against liberty and freedom.

Folks, a WAR has been declared on the Bill of Rights if you haven't noticed......OUR RIGHTS, so that's a declared war on the people. Period.

Seems the people literally have to be walking up the steps to the guillotine before they realize or believe they're being systematically subjugated.

Trump has already lost the case. He's been found liable of comitting fraud. The only things this trial is going to determine is how much money he will be paying in fines and disgorgement.
