How does knowing the exact contents of the documents change his defense? Does it really matter if he doesn't know whether the document detailing a possible invasion plan is about Iran or Saudi Arabia? Does his defense drastically change if the document about a foreign nation's nuclear capabilities is about Israel instead of South Africa?
They found thousands of pages of classified documents at MAL after he was subpoenaed to turn them all over. There's no denying those facts. This case doesn't hinge on the contents of the documents, which the lawyers do have access to. It hinges on the nebulous part of the law that is focused on Presidential authority.
Presidential Records Act - States that the United States shall reserve and retain complete ownership, possession, and control of all Presidential records.
