The USC defines enemy as:

Hostilities is defined as:

Even if we look past that, Mattis' actions probably wouldn't pass the Cramer Test. He could easily argue that he believed he was acting in the best interests of the country, while the Cramer Test requires two witnesses to testify against you that you were intentionally seeking to harm the United States.

I still don't believe there were any balloons. I believe the left got busted allowing a Chinese spy balloon to cross the US so their immediate defense was to say the same thing happened under Trump. I don't think shooting it down after it reached the point of no return was a good look either, it was too late at that point. This is really not much different than all of those lunatics the FBI monitors for a few years, then takes said people off of the watchlist, coincidentally, just before those loons go shoot up a school or church.

Our current POTUS is beholden to China and has been for many years. Perhaps they should be withholding information from him-for VERY good reasons? AND the football-just in case.

The reason treason is the only crime defined in the Constitution is because the Founding Fathers were most worried about it being abused by the government. This stems from a history of governments that would use treason charges to punish those with unpopular political opinions.

Based on this history, the courts have always taken a very narrow definition of treason.
