That's odd then that his lawyers aren't saying that, no? They are just claiming he had a right to have classified docs at MAL. As if classified docs are not the property of the government. They claim its normal for an ex president to have these docs at his home. Although we have never heard of ex presidents having classified docs at their home or fighting NARA for 18 months to return Presidential records.

They have not addressed the fact that even if he has some sort of right, he still mishandled the documents either. The surveillance video of who handled, moved, etc the docs in and out of the secure area will be an interesting watch I'm sure.

About 33,000 pages of documents are involved, according to the National Archives, which runs the library.Under the Presidential Records Act, such records can be withheld for up to 12 years after a president leaves office.



The withheld files at the Clinton Library are under the control of the federal government.


Your other link which I went to the original source it's referencing, is referencing Hillary and Berger and makes no mention of what Obama supposedly destroyed.

It also stressed the importance of the Archivist obtaining Presidential records. That's ironic.


As for the warrant, if there was an error in the past, you can bet there would not be going forward. A national security issue is too important to have any errors in the request.

Documents that were marked classified. Note the doj's OWN words.

Kash patel, mentioned in the subpoena, says they did not have time in the last days to go through each document and stamp all the pages unclassified. But they are.

And the FBI not arresting Donald Trump is proof.

Once again, Trump's lawyers are not arguing that the documents have been declassified. They're arguing that there's no issue with a former President having classified documents due to executive privilege.

If the documents had been declassified then why are Trump's lawyers not going with that argument? Why instead are they going for the extremely flimsy executive privilege argument? Why are they making a point that his new lawyer, Jim Trusty, can review the top secret documents since he has a clearance from his time working at the DOJ?

The detailed inventory has been released. We're looking at 20+ classified documents mixed in with unclassified documents. Perhaps more frightening however was the discovery of 43 empty folders with Classified markings. Where are those 43 documents?

Trump’s legal team from today onward:

So judge, did you happen to catch Joe Biden’s speech on Sept 1, 2022 or read a transcript of it? Did it sound like maybe some political biases MIGHT be going on in the Executive Branch in which both the DoJ and FBI are a part of, including the AG of the US? Could a single minded, politically motivated organization with such power and weight of the FBI and entire DoJ and even the POTUS himself possibly find a judge, magistrate, arbitrator or even mediator to sign off on a warrant that may or may not have been on the up an up?

Your honor, we move to dismiss with prejudice this and any future matters that may arise as third world style political stunts.

The warrant covered non-classified documents. It was for any document that appeared to be property of the US government (ie any government document produced during Trump's time in office.)

I suspect Trump is, and has been, threatening to expose state secrets in retaliation, to extort and intimidate the federal government, not mention the threats of riots in the streets.

I suspect the government has enacted and is preparing safeguards against exposed agents, methods and means and other issues.

You are moving the goalposts. His lawyers are aware he had classified documents. His lawyers attested that they returned all the classified material in June. Trump and his record keepers lied, or his attorneys lied. There has been no President prior that had kept classified documents at his home while spending 18 months arguing with NARA about returning them.
